After a Farmington Hills or Michigan car crash, you may be able to sue the at-fault driver for pain and suffering. Here, the Davis Law Center explains Michigan’s no-fault laws, the “serious impairment” threshold, and how long you have to file a lawsuit.

Q: I was in a car accident in Michigan. Can I sue the at-fault driver?

A: Michigan is a no-fault state, meaning your own insurance company typically covers your medical expenses and lost wages, regardless of fault. This is called Personal Injury Protection (PIP) benefits. However, you can sue the at-fault driver in Farmington Hills and throughout Michigan for certain damagesif your injuries meet a specific legal threshold. We can help you determine if your case qualifies.

Q: What is the “serious impairment of body function” threshold?

A: To sue for pain and suffering in a Michigan car accident lawsuit, your injuries must meet the “serious impairment of body function,” “death,” or “permanent serious disfigurement” threshold. The law defines serious impairment as an objectively manifested impairment that affects an important body function of great value or consequence to you, and it must have influenced your general ability to live your normal life. Our firm has extensive experience in proving that our clients’ injuries meet this legal standard.

Q: What kind of damages can I sue for after a car accident in Farmington Hills, Michigan?

A: If your injuries meet the serious impairment threshold, you can sue the at-fault driver for non-economic damages, such as:

Pain and suffering

Emotional distress and mental anguish

Fright and shock

Denial of social pleasures and enjoyments

Embarrassment, humiliation, or mortification

You may also be able to sue for “excess economic losses” that go beyond your no-fault insurance limits, such as future lost wages or medical bills not covered by your policy.

Q: Is there a cap on pain and suffering damages in a Michigan car accident lawsuit?

A: Unlike some other states, Michigan does not have a general cap on non-economic damages (pain and suffering) for personal injury cases arising from a car accident. This means there is no limit to the amount you can be awarded for your pain, suffering, emotional distress, and loss of enjoyment of life. However, certain types of cases, such as medical malpractice, may have different rules. For car accident victims who meet the “serious impairment of body function” threshold, the full extent of their pain and suffering can be sought from the at-fault driver.

Q: How does a car accident settlement work in Michigan?

A: The settlement process in Farmington Hills and throughout Michigan involves two central claims. First, your own insurance company pays for your medical bills and lost wages through your no-fault PIP benefits. Second, if your injuries are serious, we negotiate a “third-party” settlement with the at-fault driver’s insurance company to recover compensation for your pain and suffering, as well as any economic losses not covered by your no-fault benefits.

The timeline for a settlement can vary widely depending on the severity of your injuries, the available insurance coverage, and whether the other side is willing to negotiate fairly. Our goal is to handle all communications and negotiations on your behalf, so you can focus on your recovery while we fight for the maximum compensation possible.

Q. What happens if my Michigan automobile accident does not settle?

A: Cases often go to trial when the insurance company either denies liability (argues their client was not at fault) or makes an unacceptably low settlement offer that does not cover the full extent of your damages. This happens when the insurer disputes the severity of your injuries, questions the medical treatment you received, or attempts to shift some of the blame for the accident onto you. Our job then is to prove the other driver’s negligence and the full impact of your injuries to a judge and jury.

Q: What is the litigation process after a lawsuit is filed?

A: Once a car accident lawsuit is filed, the case enters the litigation phase, which generally includes these steps:

Filing the Complaint: We file a formal document, called a complaint, with the court, which officially starts the lawsuit. This document outlines your allegations against the at-fault driver and details the damages you are seeking.

Discovery Phase: Both sides gather evidence and information. This involves formal requests for documents, such as medical records and employment history, as well as sworn testimony from witnesses and parties involved in the case (known as depositions). This is a critical stage where we build the evidence to support your claim for pain and suffering.

Case Evaluation & Mediation: In Michigan, many courts require a case evaluation or mediation. A neutral third party, often a panel of attorneys, a retired judge, or an attorney who specializes in this area of the law, listens to arguments from both sides and provides a non-binding opinion on the value of the case. While not a trial, this step often encourages settlement.

Trial Preparation: If a settlement is still not reached, we enter the final phase of preparing for trial. This involves preparing exhibits, coordinating with expert witnesses, and preparing our client for testimony.

Q: How long does a car accident trial last in Michigan?

A: The duration of a car accident lawsuit can vary widely. While most cases settle before trial, the litigation process itself can take anywhere from a few months to a few years. Factors that influence the timeline include the complexity of your injuries, the number of parties involved, and the court’s schedule. The trial itself may only last a few days to a week. We work efficiently to move your case forward while ensuring we gather all the evidence needed to build a strong case.

Q: What happens during a personal injury trial?

A: A personal injury trial is a formal court proceeding where we present your case to a jury. The process includes:

Jury Selection: We select a group of people from the Farmington Hills and Oakland County community to serve on the jury.

Opening Statements: Both sides give an overview of the case and what they intend to prove.

Presentation of Evidence: We call witnesses, including medical experts and accident reconstruction specialists, to testify on your behalf. We also present documents, photos, and other evidence to prove the at-fault driver’s negligence and the severity of your injuries.

Closing Arguments: After all the evidence is presented, we make a final argument to the jury, urging them to rule in your favor.

Jury Deliberation & Verdict: The jury discusses the evidence and decides on a verdict, including the amount of compensation you should receive.

Q: How can Davis Law Center help me if my case goes to trial?

A: Our firm is dedicated to achieving the best possible outcome for our clients, whether through a fair settlement or a favorable verdict at trial. We have a strong track record of success in the courtroom. We will handle all aspects of the litigation process, from gathering evidence and dealing with insurance adjusters to presenting a compelling case to a jury. We have the experience and resources to fight for the compensation you deserve, even if it means going all the way to trial.

Q: What is the deadline for filing a car accident lawsuit in Michigan?

A: In Michigan, the statute of limitations for filing a personal injury lawsuit against the at-fault driver is generally three years from the date of the accident. However, it’s crucial to act quickly. For claims related to no-fault insurance benefits (PIP), the deadline to file a lawsuit against your own insurance company is generally one year from the date an expense was incurred. Missing these deadlines could mean losing your right to seek compensation. If you have been the victim of a car crash, it is essential to contact a Michigan personal injury attorney quickly to avoid missing critical deadlines.

Q: What should I do if I’ve been injured in a car accident in Farmington Hills, Oakland County, or Metro Detroit?

A: The first step after any car accident is to seek medical attention for your injuries. After that, you should contact an experienced personal injury attorney. It is essential to have a legal professional on your side to navigate the complexities of Michigan’s no-fault laws and to ensure you receive the compensation you deserve. We serve clients throughout Michigan, including Farmington Hills, Detroit, and the surrounding areas.

Q: Does Davis Law Center charge me a fee to start my case?

A: No. We offer a free, no-obligation case evaluation. Our firm works on a contingency fee basis, which means you pay nothing up front. We only get paid if we successfully recover compensation for you through a settlement or a jury verdict. Contact us today for a free consultation to learn more about how we can help you.

The moments after an accident are frenzied. A person’s adrenaline is pumping, they are trying to process what just happened, and they likely aren’t thinking very clearly. Because of this, a person might feel totally fine in the moments after an accident and think they are OK. It is only a few hours (or days) later, after the adrenaline has died down, that they begin to notice a pain in their back or neck. This is why it is so vitally important to see a doctor as soon as possible after an accident. This way, a Detroit injury lawyer can connect your injuries to the accident in question.
In order to be successful in your injury claim, you will need to prove that the injuries you suffered were actually caused by this particular accident. While this might sound obvious, there are times when causation might not be so clear-cut. For example, if a person waits several months after an accident, it is possible that the insurance company will try to claim that the injuries were caused by some subsequent event and the injured person is just trying to cash in on the accident. If they can convince enough jurors that this is the case, they will be successful in court.

Even if you don’t feel pain immediately after an accident, it is best to see a doctor. Again, because a person’s adrenaline is pumping, they may not be aware of the signals their body is sending them. Even if you think you aren’t injured, it is best to see a doctor as quickly as possible and seek some follow up treatments. This way, you can be sure that you are getting the medical help you need to get healthy and any injury case you may choose the evidence you need to prove causation.

At Davis Law Center, we have helped many people after a variety of accidents.

One of the tricks the insurance company tries to play with an injured person is to convince the person that the insurance company isn’t liable. They try to convince the injured person that they were actually at fault for injuries and they won’t get anything from a jury. The may try to use this argument to bully the injured person into accepting a low-ball settlement offer, telling the person to “take it or leave it.” Ultimately, the jury has the final say in who is at fault and just how much the other party should get (if anything). A personal injury lawyer can fight to get you the money you need and work to convince a jury that the other party was negligent.
This right to a jury trial is actually included in the Bill of Rights. This is how important our Founding Fathers saw this right. Were it not for the right to a trial by jury, injured parties and those of limited means would get steamrolled by the rich and by big corporations. The civil justice system provides an equal playing field for all parties involved, allowing a jury of our peers to ultimately decide the merits of a particular case.

If the insurance company has denied responsibilities for your injuries or is trying to bully you into accepting a low settlement, a personal injury lawyer can fight to get you the money you deserve. Before allowing yourself to be bullied after your car crash, slip and fall, or other negligent injury, work with an attorney who will fight for the money you deserve.

At Davis Law Center, we know how frustrating it can be to deal with the insurance company after an injury. We know their tactics and know how to fight back. We will do everything possible to get you every penny you deserve after an injury. For a free consultation to discuss your case, contact Davis Law Center right away.

When someone is injured in an accident, they understandably want some assurance that they will get the money they need. Unfortunately, no personal injury attorney can ever guarantee success in a case. This is frustrating for an injured person, but it is the only honest, ethical answer a lawyer can give. What the law firm can do, however, is make sure that they do everything possible to achieve a positive outcome for a particular client.

Investigative Process in Accident Cases

This means that an attorney will conduct a proper investigation of a particular accident and a thorough analysis of a person’s injuries. When investigating an accident, the attorney might have a private investigator get witness statements, take pictures of where the injury occurred, and reconstruct a particular accident to prove the injury was their fault. This is essential in getting the money you need.

Importance of Evaluating Injuries

Evaluating injuries is also vitally important because it is the only way to ensure that a person gets full compensation for their injuries. Since a personal injury settlement or verdict must cover a person for the rest of their life, it is important to ensure that future medical is accounted for. For example, if back surgery is needed to repair a herniated disc, then the money for that surgery needs to be included in this settlement.

At Davis Law Center, we will do everything possible to achieve a positive outcome in your case. While we cannot guarantee success, we can guarantee that we will properly investigate your case and evaluate your injuries.
When a person is injured on their motorcycle, contacting a lawyer is often the last thing on their mind. They are more focused on getting better after their catastrophic injuries. This is understandable, but time is of the essence after an accident. Not only are there statute of limitations issues, but evidence needs to be collected as soon as possible after the accident. A Detroit Motorcycle Accident Attorney can get to work right away after an accident, focusing on your case as you focus on recovering from your injuries.

Gathering evidence is vital to proving your claims. By contacting a lawyer right away, you can be sure that witnesses are contacted immediately and that their statement is taken while the memory of the accident is still fresh. Since people routinely move around or change phone numbers and become impossible to locate, this contact information can be lost if someone waits too long to contact a Detroit Motorcycle Accident Attorney.

Likewise, some people forget the names of health care providers if they wait too long. Since people see many specialists and doctors after a serious injury, it is possible to miss a doctor who has important medical records that can prove an injury. A lawyer can make sure that these records are collected immediately and gathered as a person treats.

At Davis Law Center, we have helped many clients injured after motorcycle accidents. We understand how difficult this time can be and we will work to help you through it. We aggressively fight to get you every penny you deserve after an accident. To speak with a Detroit Motorcycle Accident Attorney about your injuries, contact Davis Law Center today for a free consultation.

Personal injury lawyers have a negative reputation in some circles. Commonly called “ambulance chasers” and other derogatory terms, these attorneys and their clients are sometimes viewed as a person out looking for a quick buck. While this isn’t the case in most instances, it is a relatively common perception. Therefore, it is important for an injured person to always tell the truth and remain as credible throughout the process. By being honest with your Detroit Personal Injury Attorney about the details of the accident, prior injuries, and all information that may be relevant to your case, you can be sure to protect this credibility.

It is natural for injured people to want to downplay any mitigating circumstances that could impact their case. For instance, a person may not have been wearing their seat belt at the time of the injury and they worry that this may cause them to lose any possibility of recovery. Fortunately, this is not the case. While it might cause a jury to assign some blame to you, it will not immediately prevent you from recovering damages. What will torpedo your claim even faster is lying or attempting to cover up certain facts. Once an insurance adjuster finds out that a person has lied, they will immediately begin playing hardball and will do everything possible to prevent you and your Detroit Personal Injury Attorney from recovering anything. If the case eventually goes to trial, they will point out this inconsistency and paint you as someone who just wants an easy paycheck and isn’t really hurt. A lawyer can deal with issues in the case, but losing credibility is extremely difficult to overcome. Therefore, always be honest about the facts of your case, lest you wind up significantly harming your chances of getting the money you need.At Davis Law Center, we fight to achieve the best possible results for your particular case. Even if there are certain factors that may be detrimental to your recovery, we will work to minimize their impact or exclude the jury from knowing about them entirely should they be irrelevant. We aggressively work to get you the money you need as you focus on recovery from your injuries. For a free consultation with a Detroit Personal Injury Attorney, contact Davis Law Center right away.

Although Michigan is a “no-fault” state and you will have coverage from your own insurance should an accident occur regardless of who is at fault, you may be able need a Michigan accident lawyer to help make sure you are able to recoup damages from those involved.
Some people assume that they can handle a personal injury case on their own. They think they can get a similar settlement and, without having to pay attorney’s fees, will actually have extra money left over. It is certainly a person’s right to handle their own case, but it should be noted that it’s generally not wise. Before trying to handle your own case, speak to a personal injury attorney for a free consultation to learn how they may be able to help.
Some studies have shown that people with attorneys collect more in their settlement than people without an attorney, even when accounting for attorney’s fees. If this sounds incorrect, consider that an attorney knows how to properly evaluate a case and properly value injuries. When people handle a case on their own, they often leave out important damages like future medical and non-economic damages. These can be substantial so it’s important to know just what types of injuries you are facing.

Personal injury lawyers are extremely familiar with injuries and know exactly what to seek when trying to settle a case. They also have access to experts who can prove these injuries and bolster the evidence that proves their worth. This is vital when seeking damages and proving a person’s case. If you handle a case on your own, you may not have the same resources at your disposal to prove your case.

At Davis Law Center, we have helped clients throughout Detroit and across Michigan get the help they need after an accident. We know hot evaluate your injuries and will do everything possible to get you a fair amount for your damages. We will work tirelessly to make you as whole as possible after your accident. For a free consultation to discuss your injuries, contact Davis Law Center today.

There are times when an insurance company jumps in after an accident and makes an offer. Often, they tell the injured person that this is the best they can expect. They also tell the injured person that if they don’t accept it, they may not receive any money whatsoever. This pressure is extremely difficult for someone also dealing with a serious injury. A personal injury lawyer can be of great help during this time. Before accepting any money from the insurance company, contact Davis Law Center for a free consultation.
These bullying tactics are very common with insurance companies. They know that a person doesn’t know how to properly evaluate their claim. They also know that if they can get a person to accept a settlement that is far less than they should receive. This is why it’s so important to speak to a lawyer before accepting a settlement – once you have settled your claim that is the end of it. You cannot go back, even if further treatment is needed.

A personal injury lawyer knows how to evaluate claims and knows how to get an injured person the compensation they deserve. They will deal with the insurance company and make sure that the injured person is treated fairly. Don’t be bullied into accepting an offer that is far too little to properly compensate you.

At Davis Law Center, we have helped clients throughout Detroit and across Michigan get the help they need after an accident. We know how difficult it can be to deal with the insurance company on your own. We will aggressively fight to get you the compensation you deserve. Before accepting any settlement offer, contact us today for a free consultation. We will get you the money you deserve.

In every personal injury case, the goal is to make the injured person as whole as possible after an injury. But what exactly does “made whole” mean? Specifically, it means to return a person to the state they were in before an accident occurred. Since we don’t have a time machine to take a person back to prevent an accident, we use money to compensate people for their injuries. It is not perfect, but it is the only tool available to help someone after an injury accident.

As an example, let’s imagine a person is struck by a drunk driver. This person is very fortunate and only suffers damage to their vehicle but doesn’t suffer any injuries. They walk away completely unharmed save for the property damage to their case. To make this person whole, the at-fault driver’s insurance company will only need to cover the damage to the vehicle. If, however, the driver above suffered serious injuries from the drunk driver, the monetary amount would be much greater. This injured person would need to be made whole from the immediate treatment the received from the paramedics and the emergency room doctors. There would then be follow up visits to their primary care physician, specialists to look at specific parts of the body, and physical therapists needed to help them rebuild strength. These damages would be substantially more since there was a greater loss. This is important because it helps a person know what to expect from their personal injury matter. Being injured in a car accident won’t result in some huge, unearned windfall. But it also shouldn’t require someone to pay for damages out of pocket when they were caused by the negligence of another. A car accident lawyer can review the facts of your case to give you an idea of how your case will proceed. At Davis Law Center, we aggressively fight to make sure you are properly compensated for your injuries. We do everything possible to make you whole due to the damages you have suffered. For a free consultation to discuss your case, contact Davis Law Center today for a free consultation.

As a Detroit injury attorney, too often we see cases where a terrible accident is made much worse because the people involved were not secured in proper safety belts or devices. This may be especially true with children. It may also be quite confusing to truly know when children should be restrained and what seat is truly appropriate for the child’s age and weight.

From the time you bring your child home from the hospital until they are in grade school, he or she must be properly restrained with an age and weight-appropriate device while riding in any motor vehicle. Here is an overview of the general car seat laws and recommendations from Michigan’s department of motor vehicles’ web site:

Experts recommend a baby or toddler ride rear-facing until he or she is two years old or until he or she reaches the highest weight or the highest height allowed by the car seat.

When a child is at least two years old or has outgrown the weight or height limit of their rear-facing seat, he or she should be restrained in a harness until he or she reaches the weight or height limit.

As a child outgrows his or her harnessed car seat, he or she moves to a belt-positioning booster seat, which the child will be in until the vehicle seat belt properly fits the child without the booster. For most children they outgrow their booster between the ages of 8 – 12, when he or she reaches 4 feet 9 inches tall. From then on out, a child may ride with a regular seat belt, but should always use both a lap and shoulder belt for the most safety.

In Michigan, all children younger than age four must ride in the back seat of a vehicle if there is one available. If all back seats are filled with children, then a child younger than four may ride in the front seat. Everyone younger than 16 must use a seat belt regardless of where he or she is seated in the vehicle. Additionally, everyone riding in the front seat must be wearing a seat belt.

A child in a rear-facing car seat may only ride in the front is the air bag has been disabled.

According to the Michigan DMV, more than 70 percent of car seats are not properly installed. If you are the parent of small children, it is important to know which car seat is the best choice to protect your child. If you have been involved in a serious motor vehicle accident, you may benefit from speaking with a personal injury attorney. Call today for your free, initial consultation.

The reason it is imperative to contact a Detroit Injury Lawyer as soon as possible after an accident is that there are strict time limits to when a lawsuit must be filed. In Michigan, a lawsuit must be filed on or before 3 years from the date of injury or it will be forever barred. For instance, if a car crash happened on October 13, 2014, the lawsuit must be filed on or before October 13, 2017. By working with an attorney, you can be sure that you will not miss this important date.

Some people may attempt to represent themselves in a personal injury matter. Maybe they have had bad experienced with attorneys in the past and don’t trust them, maybe they worry that they cannot afford a Detroit Injury Lawyer. While you have every right to attempt to negotiate a settlement, it is important to note that most people who have an attorney wind up getting more for their injuries, even after accounting for attorney’s fees. If you worry that it will be too expensive to hire an attorney for your injury matter, this fear is generally unfounded.

Contingency Fee Explained by a Detroit Injury Lawyer

Personal injury attorneys work on what is known as a “contingency fee,” which means we don’t get paid unless we collect for our clients. Generally, this fee is somewhere between 33-40%, depending on the nature of the case and whether it goes to trial.

The contingency fee means that a Detroit Injury Lawyer has a vested interest in getting you maximum compensation for your injuries. Since our fee is directly related to your settlement or verdict, we will carefully examine any offer to determine if it’s fair. This way, you can be sure you are not leaving money on the table or settling for less than you deserve.

At Davis Law Center, we offer a free consultation to all of our clients to learn about their injuries and explain how we can help. There is never any financial risk for our services. We make sure that our clients are comfortable with our fees and sure they are getting the representation they want and deserve.

Experienced Detroit accidents lawyer know that part of keeping children safe in the event of an accident, is making sure the child is securely restrained. Most parents would not willingly cut corners in this area, but according to the National Highway Traffic Safety Administration, three out of four car seats are improperly installed. This means that in case of an accident, there is more of a chance of injuries to those in improperly installed seats. Furthermore, many parents have their child in a seat that the child’s body is not quite ready for.

Detroit Accidents Lawyer Reviews Tips For Car Seat Use

First of all, the current recommendation is that all children two and younger be rear-facing. The old recommendation was that children stay rear facing until one, but recent research has shown that children’s neck muscles are more fully developed at age two. This means the muscles are better able to support the child’s head should the vehicle be involved in a motor vehicle accident.

Choosing the appropriate car seat for the height and weight of the child is another appropriate step. Often parents “graduate” their young child to booster seats before a child is big enough. This can be detrimental for a child in an accident.

It is important to use the LATCH system when possible, which includes a strap from the top of the seat to tether the top as well. All seats and vehicles manufactured after 2002 are required to be equipped with the LATCH system. The system was created in an effort to make correct installation easier for parents. If a seat is forward facing, the top tether should be in place.

It is important that a seat not move at all when installed. That means it should not be able to move side to side or up and down when pushed by an adult.

Although some used car seats may be ok, unless you are confident you know the entire history of a car seat, including whether it was ever involved in a crash and know it is not expired, you don’t want to risk your child’s safety.

Children younger than 13 should ride in the back seat whenever possible.

These steps help prevent deaths in motor vehicle crashes. According to the American Academy of Pediatrics, even though deaths among children 16 years old and younger has dropped 45 percent in the past decade, it is still the leading cause of death for children ages four and older. If you or your loved one has suffered serious personal injury in any type of motor vehicle accident, it is important to speak with a Detroit accidents lawyer who can review your case and advise you on what steps you should take.

As loved ones age, it may become apparent they need to give up driving for their safety as well as the safety of those surrounding them. As a Detroit personal injury lawyer, I know many accidents do not stem from any ill will or any harsh feelings nor do they stem from direct carelessness, but may stem from an older adult getting too old to safely operate a vehicle.

Detroit Personal Injury Lawyer Discusses Concerns

There is no finite age in which it becomes unsafe to safely operate a vehicle, which can make approaching the subject ever more challenging. For some, they may safely drive until they reach their mid 80s, while others should really give up being behind the wheel in their late 60s or early 70s. Because we rely so much on driving to get around though, it can be suffocating to some to give up the freedom that driving allows a person.

It is important to be as gentle and loving as possible when broaching the subject. Obviously it can be quite sensitive, but if you have concerns and qualms about a loved one’s ability to safely operate a vehicle, they may be valid and may warrant a closer look.

If approaching a loved one about their driving, it is imperative to have a plan in place for how they will still be able to do all their errands, get to their appointments and visits family and friends.

As a Detroit personal injury lawyer, I see way too many accidents that may have been avoided if a few simple steps were taken. If you or your loved one has suffered serious injuries in any type of accident, it is important to talk with a Detroit personal injury lawyer today.
As the warmer temperatures approach, it is important to review the many causes of accidents within vehicles. Although many accidents occur as a result of a crash or collision with another vehicle, some tragic accidents can occur when a vehicle is not even in motion. Too many children left within vehicles die every year in accidents that could have been prevented. If your loved one has died as a result of someone’s negligence and you believe that person may be to blame, it may be wise to contact a Detroit auto accidents lawyer.

Statistics from a Detroit Auto Accident Lawyer

A Detroit auto accidents lawyer handles all types of cases, including tragic cases where a child may have been left in a vehicle and suffered irreversible health consequences and in the most extreme cases, may have lost his or her life due to the incident. Last year nearly fifty children died from being left in a car. On average, at least 33 children lose their life each year. Since 1998, an average of one child every day loses his or her life due to heat stroke suffered from being left in a vehicle. It may seem alarming, but according to safecar.gov, in just 10 minutes a vehicle can heat up 20 degrees Fahrenheit. While cracking the window may cool off the car a bit, it usually does very little. Even when temperatures are in the 60s, a vehicle can heat up to well above 110 degrees. A child’s body temperature may rise up to five times faster than an adult’s and a child will die when his or her temperature reaches 107. Because of this, heatstroke may occur when the temperature is as low as 57 degrees. An adult who is charged with endangering a child left in a vehicle or with the death of a child left in the vehicle may face a range of punishments from misdemeanor and a fine to a felony. If your loved one has been injured or has been killed because he or she was left unattended in a vehicle, you may want to discuss your situation with an experienced Detroit auto accidents lawyer today. Call The Davis Law Center for your free, initial consultation.

A study examining older adults’ cognitive abilities while driving showed that although there was a decline in their ability to drive safely, much of the level of errors depended on whether or not the driver was driving familiar roads or in unfamiliar areas. As a Detroit car accident attorney, this is an important study.

Researchers at Rhode Island Hospital’s Alzheimer’s Disease and Memory Disorders Center confirmed what other studies have shown that driving abilities decline with age and those with cognitive issues such as dementia or Alzheimer’s may have a more severe decline in abilities because of their condition. However, they went a step further than many studies have ventured in the past and took a look at how drivers did when going about their regular daily routines.Researchers placed cameras in personal vehicles of test subjects for two weeks and compared the results to the standardized road test that is often used to measure an individual’s ability whether they are a new driver, renewing a license or older driver. They studied 103 older adults, some who were healthy and others who were cognitively impaired driving for two weeks in their own vehicles, going about their regular routines and found that in their natural driving states, drivers performed better than in standardized testing. Researchers concluded standardized testing may require more cognitive abilities than what is required of a driver in their normal routine.Lead author Jennifer Davis, PhD, of the department of psychiatry pointed out that while it is natural to worry about older drivers, especially if they have cognitive issues, many of the participants drove safely in the study.“Receiving a diagnosis of Alzheimer’s disease shouldn’t result in an automatic revocation of an individual’s driver’s license,” she said. “Rather, it should emphasize the importance of monitoring an older person’s driving, so that he or she can safely maintain their mobility and independence for as long as possible.”If you or your loved one has suffered any type of serious injury in a motor vehicle crash, it is important to discuss your situation with an experienced Detroit car accident attorney. At Davis Law Center, we have helped many drivers struck by elderly drivers and can get you the money you deserve.
Accidents happen and most drivers will be involved in at least one in their lifetime. Understanding what you need to do in the case of an accident it is important. Taking the right action after an accident will help make sure it is handled properly and efficiently. A Michigan auto accidents attorney is able to help you navigate the system and may be able to help you get compensated when you are injured.

Michigan Auto Accidents Attorney: The First Steps

Taking initial steps to report and record the information at the accident scene will help you immensely when dealing with the aftermath.

First of all, you should always contact the police right away. This ensures medical personnel are headed to the scene to examine everyone involved in the crash. It also will make sure you have an official police report to document any damages.

While you are at the accident scene, you want to collect the other driver’s information like name, telephone number, address and insurance information. If you suspect the other driver is impaired, it is important to tell an officer when one arrives. If there are any witnesses, you will want to collect their names and contact information as well. If you have a camera or smartphone and are able to, take pictures of the accident scene and the damage.

After the accident, you will want to notify your insurance company. You need to obtain a copy of the police report for your records as well. Know that all injuries are not always apparent right away, so it is important to make an appointment with your doctor so he or she may be able to assess your situation.

As important as it is to speak with your insurance company, it is important to not speak with the other driver’s insurance company or accept a settlement. If you have suffered serious injuries, you will want to secure a Michigan auto accidents attorney who can help you get the compensation you deserve.
