When you are injured in a car accident in Michigan, you will typically turn to your own PIP coverage first to pay for your medical bills and related expenses. These are known as “first-party benefits.”</p>

<p>The coverage level you choose will determine how much your no-fault PIP insurer will pay for your medical expenses after a collision. If your medical bills exceed your PIP coverage limit, you may need to turn to other payment sources, such as your own health insurance, Medicaid, Medicare, or personal savings.  If another driver was at fault, you may also attempt to obtain the excess benefits by suing him or her for negligence.</p>

<p>When you purchase your auto insurance policy from a Michigan insurance agent, you may also have the option to choose between coordinated and uncoordinated PIP coverage. This is just an option, however, and your insurance carrier is not required to offer it to you.</p>

In Michigan, to <a href="/how-do-i-file-a-car-accident-claim-in-michigan/">file and prevail on such a claim</a>, the injured party must demonstrate he or she suffered a <a href="https://www.legislature.mi.gov/Laws/MCL?objectName=mcl-500-3135">serious impairment of body function or permanent disfigurement</a> in the crash.  Claims for non-economic damages (pain and suffering) against an at-fault, uninsured driver are more complicated, however.</p>



<h2 class="wp-block-heading" id="h-the-problem-of-uninsured-drivers-and-the-importance-of-obtaining-uninsured-motorist-coverage-through-your-own-insurance-company">The Problem of Uninsured Drivers And The Importance Of Obtaining Uninsured Motorist Coverage Through Your Own Insurance Company</h2>



<p>Despite Michigan’s mandatory insurance laws, many drivers in Farmington Hills, Detroit and throughout the state choose to drive without insurance. If these uninsured drivers cause an accident, victims may face significant obstacles in recovering the compensation they need to cover their losses.  This is mainly because if a driver cannot afford insurance, they also probably cannot afford to pay your damages resulting from the crash.  This is why we recommend everyone purchase “Uninsured Motorist Coverage” (UM) from their own automobile insurance company, if available. UM coverage will pay you what should have been paid by the at-fault driver, up to the limits you choose from your own insurance company.</p>



<p>For instance, say you were struck by a hit-and-run driver at the intersection of Maple and Orchard Lake in West Bloomfield and sustained serious injuries.  Let’s also say that prior to the crash, you had purchased $500,000 Uninsured Motorist Coverage from your own auto insurance company.  Depending on the severity of your injuries, you would then be able to collect up to $500,000 from your insurance company to compensate you for the pain and suffering you endured as a result of the negligence of the uninsured driver who hit you.  If you did not have UM coverage in this scenario and the uninsured driver was never identified, you would have no recourse to obtain pain and suffering damages.</p>



<h2 class="wp-block-heading" id="h-what-to-do-if-hit-by-an-uninsured-driver">What To Do If Hit By An Uninsured Driver</h2>

<h3 class="wp-block-heading" id="h-call-the-police">Call the Police</h3>



<p>Contact law enforcement immediately after the crash. Law enforcement will create an official report of the incident, which will be important for your insurance claim and any legal action you may need to take. In fact, some insurance companies require a report to be filed within 24 hours of being hit by an uninsured driver to even pursue an uninsured motorist claim.</p>



<h3 class="wp-block-heading" id="h-get-medical-attention">Get Medical Attention</h3>



<p>Even if you feel fine after being hit by an uninsured driver, we believe it’s essential to get a medical evaluation as soon as possible anyway. Some injuries, like whiplash or concussions, may not show symptoms right away. Prompt medical care can protect your health and create a record of your injuries for your claim.</p>



<h3 class="wp-block-heading" id="h-gather-evidence">Gather Evidence</h3>



<p>If possible, take photos of the accident scene, vehicle damage, and your injuries. Get the names and contact details of any witnesses who may have seen the accident occur.</p>



<h3 class="wp-block-heading" id="h-report-the-accident-to-your-insurance-company">Report the Accident to Your Insurance Company</h3>



<p>Notify your own insurance company of the accident as soon as possible. Be honest and accurate in your description of what happened, but avoid admitting fault or speculating about the cause of the crash.</p>

<p>Review your own auto insurance policy to see if you have uninsured motorist (UM) coverage. This type of coverage can help pay for your losses if an uninsured driver hits you. In Michigan, UM coverage is not mandatory, but it can provide crucial protection in these situations.  Moreover, it is relatively cheap coverage to add to your insurance policy.</p>

<p>At the Davis Law Center, we have noticed that Michigan’s no-fault car insurance system can be confusing for many drivers in Farmington Hills and throughout the State. As a car accident attorney serving clients for over three decades, Neil Davis at the Davis Law Center understands how this unique system works and how it affects you in the event of an accident. </p>



<h2 class="wp-block-heading" id="h-what-is-no-fault-insurance">What Is No-Fault Insurance?</h2>



<p>Michigan’s no-fault insurance system generally requires all drivers to carry personal injury protection (PIP) coverage, with certain exceptions discussed below. If you are injured in an accident, your PIP policy can cover medical expenses, wage loss, medical mileage, and assistance with household chores or home nursing-type services (attendant care). These benefits are payable regardless of who was at fault. PIP coverage doesn’t apply to vehicle or property damage, however. Other coverages required by Michigan law are Property Protection Insurance (PPI) and Residual Liability Insurance (BI/PD).  We provide an overview of the various coverages as follows:</p>



<h3 class="wp-block-heading" id="h-personal-injury-protection-pip">Personal Injury Protection (PIP)</h3>



<p>This is the “No-Fault” part of your automobile policy of insurance.  PIP policies cover your medical expenses, lost wages, replacement services, medical mileage, and attendant care if you are injured in a car accident, regardless of who was at fault in the crash. As of July 2020, <a href="https://www.legislature.mi.gov/Laws/MCL?objectName=mcl-500-3107c">Michigan law</a> allows drivers to choose from six levels of PIP coverage:</p>



<ul class="wp-block-list">
<li>Unlimited coverage (Davis Law Center’s recommendation). </li>



<li>$500,000 limit</li>



<li>$250,000 limit</li>



<li>$250,000 limit with PIP medical exclusions</li>



<li>$50,000 limit (Medicaid-eligible only)</li>



<li>Opt-out (Medicare-eligible only)</li>
</ul>



<p>We recommend unlimited PIP coverage because of the astronomical cost of medical care after serious injury accidents.  We have had clients who opted for lower amounts, only to see those limits exhausted after a 24-hour hospital stay.  At that point, and unless you have other insurance, you could be personally responsible for all past, present, and future medical care.</p>



<p>Aside from medical expenses PIP coverage can also provide:</p>



<ul class="wp-block-list">
<li>Up to 85% of your lost wages (subject to an annual cap) for up to three years from the date of the crash, if you cannot work due to accident-related injuries.</li>



<li>Replacement services, such as household help, are available if your injuries prevent you from doing the tasks that you were able to do before the crash, but not after.  These are also available for the 1st 3 years following a crash.</li>



<li>Attendant Care (home nursing services provided by either friends, family, or an agency)  </li>



<li>Medical Mileage (reimbursement for mileage incurred while travelling back and forth to your medical providers)</li>



<li>Survivor’s loss benefits to your dependents if you are killed in a car accident.</li>
</ul>



<h3 class="wp-block-heading" id="h-property-protection-insurance-ppi">Property Protection Insurance (PPI)</h3>



<p><a href="https://www.legislature.mi.gov/Laws/MCL?objectName=mcl-500-3121">PPI coverage</a> pays for damage your vehicle causes to other people’s property, such as buildings, a fence on Grand River, or parked cars. The minimum required PPI coverage is $1 million.</p>



<p>It’s important to note that PPI does not cover damage to another person’s vehicle unless it was parked at the time of the accident. You would need to rely on your collision coverage or the other driver’s insurance for damage to other vehicles.</p>



<p>Property Damage (PD)</p>



<p>PD coverage in Michigan requires a minimum coverage of $10,000 to protect you if you cause damage to another individual’s vehicle outside of the State of Michigan. If you have ever taken a damaged vehicle for repairs, you know $10,000 barely covers anything. This is why we recommend at least $100,000 of PD coverage.</p>



<h3 class="wp-block-heading" id="h-residual-liability-insurance">Residual Liability Insurance</h3>



<p>This is where “Fault” comes into play in the Michigan No-Fault scheme.  <a href="https://legislature.mi.gov/Laws/MCL?objectName=MCL-500-3009">Residual liability insurance</a>, called bodily injury and property liability coverage in other states, covers injuries and property damage others incur when you cause a crash. The minimum required coverage is:</p>



<ul class="wp-block-list">
<li>$250,000 per person for bodily injury</li>



<li>$500,000 per accident for bodily injury</li>
</ul>



<p>While drivers may choose to lower the coverage to $50,000 per person and $100,000 per accident, these are minimum requirements and not recommended. We believe it’s smart to purchase higher limits to protect yourself in the event of a serious accident. For instance, if you blew through a red light at 12 Mile and Orchard Lake Road, and the other party’s losses exceed your liability coverage, they could sue you personally for the remaining amounts.  If you chose to lower your coverage to $50,000 and an Oakland County jury entered a verdict against you for hundreds of thousands of dollars, you could be ruined financially.  In our opinion, the more residual liability coverage, the better.</p>



<h2 class="wp-block-heading" id="h-limitations-of-no-fault-coverage">Limitations of No-Fault Coverage</h2>



<p>While Michigan’s no-fault system provides essential benefits, it also has limitations:</p>



<ul class="wp-block-list">
<li>No-fault insurance does not cover vehicle damage. For this, you need collision and comprehensive coverage.</li>



<li>PIP insurance also does not cover <a href="https://www.michigan-injury-lawyer.com/blog/pain-and-suffering-damages-farmington-hills/">pain and suffering damages</a>.  Compensation for pain and suffering is only available if your injuries meet certain thresholds, such as <a href="https://www.legislature.mi.gov/Laws/MCL?objectName=mcl-500-3135">serious impairment of a body function, permanent disfigurement, or death</a>. You also must prove that the other driver was more than 50% the cause of the crash.</li>
</ul>

<p>“Whiplash” is a kind of catch-all term to describe injuries that occur after an incident that causes a person’s head to violently snap back and forth. Probably the most common cause of whiplash is when a vehicle is struck from behind by another car or truck, but sports injuries and slip, trip and falls can also result in whiplash injuries. Whiplash injuries can range from mild to severe depending on how severely a person’s neck hyperextends or compresses as a result of an impact. Moreover, symptoms may not be immediate or even appear for several days following a trauma to the neck.</p>



<p>So what are the symptoms of whiplash? It really depends on how a person’s head, neck and spine react to the trauma or impact that caused the whiplash. Less severe whiplash may result in minimal or no pain or stiffness. Mid level whiplash may cause pain radiating to areas such as the face, head, back and shoulders, as well as possible muscle spasms that cause difficulty in moving one’s head and/or neck. More serious whiplash can cause quite devastating symptoms including numbness, weakness, headaches, dizziness, vision and sleep disturbances, as well as neurological problems associated with trauma to the vertebrae, discs, and nerve roots in the spine.</p>



<p>The types of treatment and length of treatment for whiplash type injuries is generally dictated by the severity of symptoms a person experiences after sustaining trauma to the head and neck. For less severe instances of whiplash, one or more of the following may be all that is needed: Anti-inflammatory medications, pain medication, muscle relaxers, immobilization and/or physical therapy. For more severe instances of whiplash, a person may need some or all of the above plus electrical nerve stimulation, injections and in some cases, spinal surgery. Obviously, the time and potential for a full recovery will depend on the severity of the damage caused by the whiplash event. Some may recover in weeks. Others may have permanent damage and never fully recover.</p>



<p>If you sustain whiplash type injuries in the State of Michigan, you may be entitled to compensation from the person or entity that caused your injury, i.e. the at-fault driver. Aside from various insurance coverage issues that will be the subject of another blog, in order to recover money damages from an at fault driver, the whiplash injuries need to be what is defined in Michigan Law as a “serious impairment of a body function.” That is defined by MCL <a href="https://www.legislature.mi.gov/(S(0hlu0cd444odhj5uqtcmeka1))/mileg.aspx?page=getObject&objectName=mcl-500-3135" rel="noopener noreferrer" target="_blank">500.3135</a> as follows:</p>



<p>“serious impairment of body function” means an impairment that satisfies all of the following requirements:<br>(a) It is objectively manifested, meaning it is observable or perceivable from actual symptoms or conditions by someone other than the injured person.<br>(b) It is an impairment of an important body function, which is a body function of great value, significance, or consequence to the injured person.<br>(c) It affects the injured person’s general ability to lead his or her normal life, meaning it has had an influence on some of the person’s capacity to live in his or her normal manner of living. Although temporal considerations may be relevant, there is no temporal requirement for how long an impairment must last. This examination is inherently fact and circumstance specific to each injured person, must be conducted on a case-by-case basis, and requires comparison of the injured person’s life before and after the incident.</p>



<p>“Objectively manifested” can range from simple things like muscle spasms to other tests like X-rays, CT scans and MRI studies that can objectively show trauma to different areas of the body. An “important body function” is simply a body function that is valuable and significant to the injured person. Depending on the person, things like moving one’s legs or arms, bending, stooping, twisting, turning, sleeping, etc. may be of great value, significance or consequence to satisfy that requirement. The last requirement is that the injured person’s general ability to lead his or her normal life is somehow affected. Every case is different and the court will compare a person’s pre-crash life with his or her post-crash life. If the impairment of an important body function has any influence at all on a person’s capacity to live his or her normal manner of living, that should meet the requirements of the statute to allow recovery against the at-fault driver.</p>

<p>MCL 257.10(b) defines a crosswalk as any designated area for a pedestrian crossing. This broad definition is likely intended to cover a wide range of situations. As a result, drivers must be vigilant behind the wheel in order not to injure or kill pedestrians while driving.</p>

In other words, motorists should anticipate crosswalks and proceed with caution around them because they should be aware that pedestrians may be in the area, and it may not be easy to see a pedestrian from a distance.</p>

While Michigan law prohibits drivers from reading, manually typing, or sending a text message while driving, more than 26 percent indicated they engaged in texting or emailing behind the wheel daily.</p>



<p>Drivers who carelessly cause accidents by texting and driving may be liable for any resulting harm under the theory of negligence. Negligence takes place when an individual fails to use reasonable care behind the wheel. Reasonable care is defined as how a prudent person would act in the same or similar circumstances. For example, a driver using reasonable care would not text and drive, understanding the risk of accidents and injuries associated with such behavior. <p>Rear-end collisions are some of the most common types of car accidents that take place in Michigan and throughout the United States. <p>A rear-end accident occurs when one vehicle strikes the back of another vehicle. According to the <a href="https://www.nhtsa.gov/" rel="noopener noreferrer" target="_blank">National Highway Traffic Safety Administration</a> (NHTSA), there are about 1.7 million rear-end collisions on U.S. roadways each year. The NHTSA found that 87 percent of rear-end collisions took place because a driver simply was not paying attention to the road. Negligence is a failure to exercise reasonable care behind the wheel and in a rear-end accident in Michigan, the driver that struck the rear of your car is presumed to be negligent. In order to succeed on an automobile negligence claim, the plaintiff must establish the following elements: i) the defendant owed the plaintiff a duty to drive using reasonable care; ii) the defendant breached this duty; iii) the defendant’s breach was a proximate cause of the rear-end collision; and iv) the plaintiff suffered a serious impairment of a body function. Under Michigan law, each element of negligence must be established before the plaintiff can recover any damages.</p>



<p>Just like all other states, Michigan imposes a time limit in which a personal injury claim must be filed, known as the statute of limitations. A No-Fault claim must be made within one year of the accident unless written notice of injury has been given to the no fault insurer or the insurer made a payment within one year of the accident and then, a claimant can only recover benefits incurred one-year back from the filing of the complaint. For a negligence claim, a plaintiff has three years from the date of the accident to file a civil claim in court. A failure to file within these time frames could mean losing your legal right to be heard by a court altogether. Thus, it is important to work with an attorney who understands this area of the law and will be vigilant about deadlines in your case.</p>

The injured person can sue the at-fault driver and, if a judgment is rendered against them their license is suspended until they pay. Unfortunately, people who flout the law by driving without insurance might have no issue driving with a suspended license, leaving the injured party the bear the full cost of their injuries.<br>In order to prevent this from happening, Michigan drivers should consider adding Uninsured Motorist Coverage (UM) to their <a href="https://www.michigan.gov/documents/cis_ofis_noflt_gd_25094_7.pdf" rel="noopener noreferrer" target="_blank">auto insurance</a>. This is generally an inexpensive addition to a policy but provides significant assistance to the injured person. With UM coverage, the insured party will have coverage up to their own limits when they are injured by an uninsured driver. They can then submit a first party claim to their insurance company to cover their damages.</p>



<p>Another addition that people may also want to consider is Underinsured Motorist Coverage (UIM). With this coverage, if they at-fault party’s insurance coverage is insufficient to cover damages, the injured person can submit a first party claim under their UIM coverage.
