As Michiganders, we are forced to deal with dangerous black ice and snowy parking lots that lead to thousands of injuries every winter. But at the Davis Law Center, we know that premises liability doesn’t have a “season.”

Whether it’s a puddle of standing water at a grocery store in July or a hidden pothole in an Orchard Lake Road parking lot in the spring, property owners have a legal duty to keep their premises safe. If you’ve been injured as a result of a slip, trip, or fall, understanding the current state of Michigan law is the first step toward the recovery you deserve.

The New Legal Standard: No More Automatic Insurance Denials

For decades, Michigan property owners relied on a legal shield known as the “Open and Obvious” doctrine. If a hazard (like a patch of ice or a large spill) was “obvious,” judges would often dismiss the case immediately, claiming the victim should have just avoided it.

That has changed. Under current Michigan Supreme Court rulings (like Kandil-Elsayed v. F&E Oil), the “obviousness” of a danger is no longer an automatic “get out of jail free” card for property owners.

The Property Owner’s Duty: They must now anticipate that a person might still encounter a hazard, even if the hazard is visible.

Comparative Fault: Today, if you slip on a hazard that was somewhat visible, a jury decides how much fault lies with the owner versus you. You can still recover compensation even if you were partially responsible.

⚠️ Hazards for Every Season

Negligence isn’t just a winter problem. Here are common hazards we see in Farmington Hills throughout the year:

Spring: Cracked sidewalks and potholes caused by the “thaw-and-freeze” cycle.

Summer: Spills in grocery stores, lack of “Wet Floor” signs near cooling units, or poorly maintained pool decks.

Fall: Accumulated wet leaves on walkways that become as slippery as ice.

Year-Round: Inadequate lighting in parking garages and broken handrails in apartment complexes.

What to Do Immediately After a Fall

Regardless of the season, your actions in the first 30 minutes can make or break your claim:

Take Photos: Document the hazard exactly as it looked when you fell.

Report It: Get a written incident report from the manager or property owner.

Identify Witnesses: Get names and phone numbers of anyone who saw the fall.

Seek Medical Care: Some injuries, like herniated discs or concussions, don’t show symptoms until days later.

Call Neil Davis: We investigate the property’s maintenance history to prove the owner knew about the danger long before you arrived.

Don’t Wait for the Next Big Freeze

The statute of limitations for personal injury in Michigan is 3 years, but evidence such as security footage or witness memories can disappear within days. Whether you fell on ice or a spilled drink, let the Davis Law Center handle the fight against the insurance companies.

After a Farmington Hills or Michigan car crash, you may be able to sue the at-fault driver for pain and suffering. Here, Neil Davis explains Michigan’s no-fault laws, the “serious impairment” threshold, and how long you have to file a lawsuit.

I was in a car accident in Michigan. Can I sue the at-fault driver?

Michigan is a no-fault state, meaning your own insurance company typically covers your medical expenses and lost wages, regardless of fault. This is called Personal Injury Protection (PIP) benefits. However, you can sue the at-fault driver in Farmington Hills and throughout Michigan for certain damages if your injuries meet a specific legal threshold. We can help you determine if your case qualifies.

What is the “serious impairment of body function” threshold?

To sue for pain and suffering in a Michigan car accident lawsuit, your injuries must meet the “serious impairment of body function,” “death,” or “permanent serious disfigurement” threshold. The law defines serious impairment as an objectively manifested impairment that affects an important body function of great value or consequence to you, and it must have influenced your general ability to live your normal life. Our firm has extensive experience in proving that our clients’ injuries meet this legal standard.

What kind of damages can I sue for after a car accident in Farmington Hills, Michigan?

If your injuries meet the serious impairment threshold, you can sue the at-fault driver for non-economic damages, such as:

Pain and suffering
Emotional distress and mental anguish
Fright and shock
Denial of social pleasures and enjoyments
Embarrassment, humiliation, or mortification

You may also be able to sue for “excess economic losses” that go beyond your no-fault insurance limits, such as future lost wages or medical bills not covered by your policy.

Is there a cap on pain and suffering damages in a Michigan car accident lawsuit?

Unlike some other states, Michigan does not have a general cap on non-economic damages (pain and suffering) in personal injury cases arising from car accidents. This means there is no limit to the amount you can be awarded for your pain, suffering, emotional distress, and loss of enjoyment of life. However, certain types of cases, such as medical malpractice, may be subject to different rules. For car accident victims who meet the “serious impairment of body function” threshold, the full extent of their pain and suffering can be sought from the at-fault driver.

How does a car accident settlement work in Michigan?

The settlement process in Farmington Hills and throughout Michigan involves two central claims. First, your own insurance company pays for your medical bills and lost wages through your no-fault PIP benefits. Second, if your injuries are serious, we negotiate a “third-party” settlement with the at-fault driver’s insurance company to recover compensation for your pain and suffering, as well as any economic losses not covered by your no-fault benefits.

The timeline for a settlement can vary widely depending on the severity of your injuries, the available insurance coverage, and whether the other side is willing to negotiate fairly. Our goal is to handle all communications and negotiations on your behalf, so you can focus on your recovery while we fight for the maximum compensation possible.

What happens if my Michigan automobile accident does not settle?

Cases often go to trial when the insurance company either denies liability (argues their client was not at fault) or makes an unacceptably low settlement offer that does not cover the full extent of your damages. This happens when the insurer disputes the severity of your injuries, questions the medical treatment you received, or attempts to shift some of the blame for the accident onto you. Our job, then, is to prove the other driver’s negligence and the full extent of your injuries to a judge and jury.

What is the litigation process after a lawsuit is filed?

Once a car crash lawsuit is filed, the case enters the litigation phase, which generally includes these steps:

Filing the Complaint: We file a formal document, called a complaint, with the court, which officially starts the lawsuit. This document outlines your allegations against the at-fault driver and details the damages you are seeking.
Discovery Phase: Both sides gather evidence and information. This involves formal requests for documents, such as medical records and employment history, as well as sworn testimony from witnesses and parties involved in the case (known as depositions). This is a critical stage where we build the evidence to support your claim for pain and suffering.
Case Evaluation & Mediation: In Michigan, many courts require a case evaluation or mediation. A neutral third party, often a panel of attorneys, a retired judge, or an attorney who specializes in this area of the law, listens to arguments from both sides and provides a non-binding opinion on the value of the case. While not a trial, this step often encourages settlement.
Trial Preparation: If a settlement is not reached, we enter the final phase of trial preparation. This involves preparing exhibits, coordinating with expert witnesses, and preparing our client for testimony.

How long does a car accident trial last in Michigan?

The duration of a car accident lawsuit can vary widely. While most cases settle before trial, the litigation process itself can take anywhere from a few months to a few years. Factors that influence the timeline include the complexity of your injuries, the number of parties involved, and the court’s schedule. The trial itself may only last a few days to a week. We work efficiently to move your case forward while ensuring we gather all the evidence needed to build a strong case.

What happens during a personal injury trial?

A personal injury trial is a formal court proceeding where we present your case to a jury. The process includes:

Jury Selection: We select a group of people from the Farmington Hills and Oakland County community to serve on the jury.
Opening Statements: Both sides give an overview of the case and what they intend to prove.
Presentation of Evidence: We call witnesses, including medical experts and accident reconstruction specialists, to testify on your behalf. We also present documents, photos, and other evidence to prove the at-fault driver’s negligence and the severity of your injuries.
Closing Arguments: After all the evidence is presented, we make a final argument to the jury, urging them to rule in your favor.
Jury Deliberation & Verdict: The jury discusses the evidence and decides on a verdict, including the amount of compensation you should receive.

How can Davis Law Center help me if my case goes to trial?

Our firm is dedicated to achieving the best possible outcome for our clients, whether through a fair settlement or a favorable verdict at trial. We have a strong track record of success in the courtroom. We will handle all aspects of the litigation process, from gathering evidence and dealing with insurance adjusters to presenting a compelling case to a jury. We have the experience and resources to fight for the compensation you deserve, even if it means going all the way to trial.

What is the deadline for filing a car accident lawsuit in Michigan?

In Michigan, the statute of limitations for filing a personal injury lawsuit against the at-fault driver is generally three years from the date of the accident. However, it’s crucial to act quickly. For claims related to no-fault insurance benefits (PIP), the deadline to file a lawsuit against your own insurance company is generally one year from the date an expense was incurred. Missing these deadlines could mean losing your right to seek compensation. If you have been the victim of a car crash, it is essential to contact a Michigan personal injury attorney quickly to avoid missing critical deadlines.

What should I do if I’ve been injured in a car accident in Farmington Hills, Oakland County, or Metro Detroit?

The first step after any car accident is to seek medical attention for your injuries. After that, you should contact an experienced personal injury attorney. It is essential to have a legal professional on your side to navigate the complexities of Michigan’s no-fault laws and to ensure you receive the compensation you deserve. We serve clients throughout Michigan, including Farmington Hills, Detroit, and the surrounding areas.

Does Davis Law Center charge me a fee to start my case?

No. We offer a free, no-obligation case evaluation.
In our practice, located conveniently on Northwestern Highway in Farmington Hills, we have seen that the widespread adoption of social media has had many unexpected consequences, including detrimental effects on Michigan personal injury cases. While you might think your posts are private, the insurance company reviewing your case has ways to view your profile and use your posts against you. In fact, with the advent of AI, 2025/2026 industry data shows that over 80% of insurers use some form of AI for “fraud detection,” which includes real-time social media scraping.

Remember, the insurance company is not your friend. It wants to deny your claim if it can, or get you to accept less than you deserve. Because insurance companies can access your social media posts, it’s crucial to know what to avoid posting and how to protect yourself.

Ways Insurance Companies Can Use Your Social Media Posts Against You

There are multiple ways insurance companies can use your social media posts against you in a Farmington Hills and Oakland County, Michigan personal injury case, including:

Photos or videos – Maintaining a consistent account of your injuries from an accident and their severity is essential to maximizing your compensation. Photos or videos showing you participating in physical activities can undercut your claim by suggesting your injuries aren’t as bad as you say. Even something as simple as a photo of you spending time with friends or family outside your home could hurt your claim. It’s also worth noting that even if you don’t post any photos or videos yourself, your friends or family might post a photo or video of you, which could damage your claim.

Written statements – While less obvious than photos, text posts create a paper trail that the insurance company would love to use against you. Perhaps you shared details of the accident with your followers that contradict your statements to the adjuster. Perhaps you told the adjuster that you were housebound, but you mentioned to a friend online that you planned to go out for drinks that evening. The insurance company could use any inconsistencies in these accounts against you.

Location data – Insurance companies don’t even need your updates or photos of your activities to undercut your claim, as they can use location data from your posts to track your movements and weaken your case. For instance, if you tell an insurance company that your injuries have largely left you homebound, a post from another location might suggest you’re exaggerating about your injuries.

How To Prevent Insurance Companies from Using Your Social Media Posts Against You

We believe the best way to keep an insurance company from using your social media posts against you is to refrain from posting until your case concludes. Staying offline means you won’t post anything that could hurt your case. If you want to talk to your friends and family about the accident, do so in person or by telephone. We also recommend asking your friends and family not to post anything about the accident or tag you in any posts. While they don’t want to hurt your case, they could accidentally say or post something that might do so.

Finally, set your profiles to private if you haven’t done so already, and do not accept any new friend or connection requests while your claim is pending. While insurance companies can find ways to view your social media accounts even when they’re supposedly private, you can avoid making it easier for them.

Car accidents are an unfortunate reality on Michigan’s roads. Whether it’s a minor fender-bender on Farmington Road or a more severe high-speed collision on I-275, the aftermath can be confusing and stressful. One step many drivers overlook or underestimate is filing a police report. Here, the Davis Law Center explains why we recommend you file a police report after a car crash.

Legal Requirements for Filing a Police Report in Farmington Hills Michigan

When a police report is mandatory

Michigan statute MCL 257.622 requires the filing of a police report following certain motor vehicle accidents. You must report the accident immediately if:

The accident results in injury or death to any person

Property damage appears to be $1,000 or more

It’s important to note that even if your accident doesn’t meet these criteria, we still highly recommend filing a report for your own protection.

Benefits of Filing a Police Report

Documenting the incident for insurance purposes

Filing a police report provides an official, unbiased account of the accident. This documentation is crucial when dealing with insurance companies:

It helps establish the facts of the accident.

It can speed up the claims process.

It provides a reliable reference point in disputes over what occurred.

Many insurance companies require a police report to be filed within 24 hours of an accident with a hit-and-run driver in order to recover benefits

Establishing an official record for potential legal action

If legal issues arise from the accident, a police report serves as a valuable piece of evidence:

It provides a contemporaneous account of the incident.

It includes important details that might be forgotten over time.

It can be used to support your version of events in court.

Gathering important information from all parties involved

A police report ensures that all necessary information is collected at the scene:

Contact and insurance details of all drivers.

Information about any witnesses.

Descriptions of vehicle damage and injuries.

Notes about road conditions, weather, and other relevant factors.

This comprehensive collection of information can be invaluable if you must pursue an insurance claim or legal action later. It saves you the trouble of gathering this information yourself in a potentially stressful situation and ensures that nothing important is overlooked.

Information to Include in the Police Report

When filing a police report after a car accident, providing comprehensive and accurate information is crucial. Here are the key details we recommend you should include:

Date, time, and location of the accident.

Personal information of all drivers involved.

Vehicle Details.

Description of damages and injuries.

Witness information and statements.

Additionally, we believe it’s helpful to include:

Weather conditions at the time of the accident.

Road conditions or any hazards that may have contributed to the accident.

A diagram of the accident scene.

Remember, it’s important to stick to the facts and avoid speculating about fault or making statements that could be interpreted as an admission of guilt. The goal is to provide a clear, objective account of what happened.

Common Mistakes We Recommend You Avoid When Filing a Police Report

When filing a police report after a car accident in Farmington Hills and Metro Detroit, it’s crucial to be cautious and avoid common pitfalls that could potentially harm your case. Here are some critical mistakes we advise steering clear of:

Admitting fault or apologizing

Avoid saying “I’m sorry” or making statements that could be interpreted as admitting fault.

Stick to factual statements about what occurred.

Remember that fault determination is complex and should be left to insurance companies and legal professionals.

Providing incomplete or inaccurate information

Don’t guess or estimate if you’re unsure about specific details.

Be thorough in your account of the accident.

If you realize you’ve made a mistake, contact the police to amend the report immediately.

Discussing the accident on social media

Avoid posting about the accident on any social media platform.

Remember that insurance companies and lawyers may use your posts against you.

Keep all communication about the accident between you, the police, your insurance company, and your lawyer.

Leaving the scene before the police arrive

If you can, always wait for the police to arrive at the accident scene. If you must leave before the police arrive, Michigan law requires you to provide the following to the other parties at the scene of the accident:

Your name and address

Name and address of the owner of the vehicle you were driving

Your driver’s license number

Your auto insurance information

Davis Law Center Caution: If you leave an accident scene involving injury or damage to another’s vehicle, you may be subject to criminal misdemeanor charges. If you leave an accident scene that resulted in serious impairment of a body function or death, you may be subject to felony charges.

Michigan is the Great Lakes State, and for residents of Farmington Hills, some of the best recreation is just minutes away on Cass Lake, Orchard Lake, and Lake St. Clair. However, a day on the water can turn catastrophic in a split second.

When a boating accident occurs, the legal “rules of the road” are different than those for a car crash. At Davis Law Center, we specialize in the complex intersection of Michigan DNR regulations and personal injury law to ensure victims aren’t left drowning in medical debt.

The Top 5 Causes of Boating Accidents in Michigan

Understanding why an accident happened is the first step in proving liability. In 2026, the most common causes cited by the Michigan DNR include:

Operator Inattention: Just like distracted driving, piloting a boat while texting or distracted is the #1 cause of collisions.

Boating Under the Influence (BUI): Michigan law strictly prohibits operating a vessel with a BAC of 0.08% or higher. A BUI is not just a crime; it is “Negligence Per Se” in a civil lawsuit.

Inexperience & Lack of Certification: Anyone born after July 1, 1996, must carry a Michigan Boating Safety Certificate. Failure to have one can lead to claims of “Negligent Entrustment” against the boat owner.

Excessive Speed & Wake Damage: Boaters are legally responsible for the damage their wake causes to other vessels, swimmers, or docks.

Equipment Failure: Improperly maintained steering or engine systems can lead to fires or loss of control.

Safety vs. Liability: How to Protect Your Rights

While safety equipment prevents injuries, documenting its presence (or absence) protects your legal claim.

Accident Cause

Prevention Tip

Legal Liability Note

BUI / Alcohol

Designate a “Sober Skipper.”

A BUI conviction is powerful evidence of liability in a personal injury case.

Wake Injuries

Observe all “No Wake” zones.

Owner are strictly liable for injuries caused by their wake, regardless of intent. MCL 324.80158

Excessive Speed

Operate the boat at a speed that allows it to stop within a safe distance.

Owners are subject to a civil infraction and a presumption of negligence for operating at an excessive speed. MCL 324.80145

Special Focus: Jet Ski and Personal Watercraft (PWC) Injuries

Jet Skis are highly maneuverable but offer zero protection in a crash. We frequently see spinal cord injuries
and whiplash resulting from PWC “jumping” wakes or colliding with larger vessels. Because Jet Skis often lack the insurance coverage of a larger boat, you need an attorney who can find “hidden” coverage in the owner’s homeowners’ policy.

Why the “Open and Obvious” Law Change Matters for Boaters

Under the landmark Michigan Supreme Court ruling in Kandil-Elsayed v. F&E Oil, property and boat owners can no longer easily dismiss cases by claiming a hazard was “obvious.” If you tripped on a loose dock cleat or slipped on an oily deck at a marina, the owner has a duty to anticipate that harm. At the Davis Law Center, we use this 2026 legal standard to fight back against insurance companies that try to blame the victim.

Accidents can happen anywhere, even on public property. If you’ve been injured while visiting a park, walking down the sidewalk on Maple Road, or entering a government building like the Farmington Hills library, you may be curious about your rights and options for seeking compensation. In this blog, the Davis Law Center discusses Farmington Hills and Michigan injuries occurring on public property and when you may be entitled to damages.

Premises Liability on Public Property

Premises liability is a legal concept under which an injured person can hold property owners responsible for maintaining safe conditions for visitors. While this often applies to private property owners, it also extends to government entities responsible for public spaces. In Michigan, including Farmington Hills and its surrounding areas, the city government, county, or the state of Michigan may be liable for injuries suffered by someone on public property due to negligence. However, pursuing a claim against a government entity for compensation can be more complicated than a typical personal injury case. Specific rules, procedures, and time limits must be followed when filing a claim against a public entity.

Your Rights as an Injured Party

If you’ve been injured on public property in Oakland County, we recoomend you:

Seek immediate medical attention

Report the incident to the appropriate authority

Gather evidence to support your claim, including the photographs of the exact location, what caused the injury, and names and addresses of any witnesses

File a notice of claim within the required timeframe

Pursue compensation for your accident-related injuries and losses

Keep in mind that your ability to file a claim may be subject to governmental immunity laws, which can limit liability in certain circumstances.

Why You Should Act Quickly

In Michigan, there are strict time limits for filing a claim against a government entity. Generally, you must file a notice of intent to sue within 120 days of the incident. In certain circumstances, however, notice must be given to the appropriate governmental agency in as little as 60 days. This notice must include specific details about the injuries sustained, the exact location where the injury occurred, the nature of the defect that caused the injury, and the identity of all known witnesses. Failing to file this notice within the required timeframe can result in your claim being dismissed, regardless of its merit. This is why it’s crucial to talk to an experienced Farmington Hills personal injury attorney as soon as possible after your injury.

Proving Negligence in Public Property Cases

To successfully pursue a claim for an injury on public property in Farmington Hills and Metro Detroit, you’ll need to prove that:

The government entity had a duty to maintain safe conditions on its property

They failed to fulfill this duty (negligence)

This failure directly caused your injury

You suffered losses (like medical bills and lost wages) as a result

Examples of negligence on public property might include failing to repair known hazards, failing to provide adequate lighting in public areas, or failing to warn of potential dangers.

Potential Compensation for Your Injuries

You could be entitled to compensation for:

Medical expenses (both current and future)

Lost wages and loss of earning capacity

Pain and suffering

Emotional distress

Rehabilitation costs

Understanding Governmental Immunity

One of the biggest challenges in public property injury cases is overcoming governmental immunity. In Michigan, government entities are generally immune from liability unless certain exceptions apply. These exceptions include:

Defective highways

Negligent operation of government-owned vehicles

Dangerous or defective public buildings

An experienced attorney can help you determine whether your case falls under one of these exceptions and guide you through the complex process of filing a claim against a government entity.

Michigan’s Comparative Negligence Rule

Michigan follows a modified comparative negligence rule. This means that if you’re found to be partially at fault for your injury, your compensation may be reduced by your percentage of fault. If you’re found to be more than 50% at fault, you will be barred from recovering compensation for your intangible losses, such as pain and suffering or loss of enjoyment of life.

Seeking Legal Assistance

Given the complexities of public property injury claims and the strict timelines involved, it’s important to seek legal assistance as soon as possible after your injury. An experienced personal injury attorney can explain the legal process, gather necessary evidence, and fight for the compensation you deserve.

Experiencing an accident can be a traumatic event, leaving you vulnerable and in need of support. During this challenging time, you may find yourself seeking legal representation and medical care to help you manage the complex aftermath of your accident. While most law firms like Davis Law Center and medical providers operate with integrity and prioritize your well-being, some engage in predatory practices that exploit accident victims for financial gain.

Red Flags

When searching for legal representation in Farmington Hills and Oakland County after an accident, be cautious of law firms that exhibit the following warning signs:

Unsolicited Contact: If a law firm contacts you without your prior consent, whether in person or via persistent phone calls, emails, or text messages, it is a red flag. Ethical attorneys, such as those at the Davis Law Center, do not engage in aggressive solicitation tactics.

Guarantees of Outcome: Be wary of law firms that guarantee a specific outcome or promise a certain amount of compensation before reviewing your case. Each accident case is unique, and ethical attorneys will provide a realistic assessment of your claim based on facts and evidence.

Pressure to Sign Quickly: This is a warning sign if a law firm pressures you to sign a contract immediately without allowing you time to review the agreement or consult with loved ones. Reputable firms understand that you need time to make an informed decision.

Lack of Transparency: Avoid law firms that are opaque about their fees, experience, or track record. Ethical attorneys will clearly explain their billing structure, qualifications, and success rate in handling cases similar to yours.

Protecting Yourself from Predatory Medical Providers

After an accident, you may require medical treatment for your injuries. While most healthcare providers prioritize your well-being, some engage in predatory practices following an accident, such as:

Unnecessary Treatments: Be cautious of medical providers who recommend unnecessary treatments, such as multiple MRIs, lengthy physical therapy sessions, or invasive procedures that do not align with your specific injuries. If you feel unsure about a recommended treatment, seek a second opinion from a trusted healthcare professional.

Inflated Billing: Watch out for medical providers who inflate their bills or charge exorbitant service fees. Request itemized bills and review them carefully to ensure you are only charged for services you received. Report the provider to the appropriate regulatory agencies if you suspect fraudulent billing practices.

Pressure and/or Payment to Use Specific Providers: If a law firm or medical provider pressures you or promises to pay you to use a specific healthcare facility or specialist, this may be a sign of a kickback scheme. Ethical professionals will allow you to choose your healthcare providers based on your needs.

Failure to Provide Proper Documentation: Avoid medical providers who fail to maintain accurate and detailed records of your treatment. Proper documentation is crucial for supporting your accident claim and ensuring you receive appropriate care. This is a red flag if a provider is unwilling to provide complete documentation.

Protecting Yourself

To safeguard yourself from predatory practices by law firms and medical providers, take the following steps:

Research and Seek Referrals: Before hiring a law firm or seeking medical treatment, conduct thorough research and seek referrals from trusted sources, such as family, friends, or reputable legal and medical organizations.

Ask Questions and Voice Concerns: Ask questions and voice any concerns about your legal representation or medical care.

Trust Your Instincts: If something feels “off” about a law firm or medical provider, trust your instincts. If you feel pressured, uncomfortable, or suspect unethical behavior, seek alternative options.

Stay Informed and Involved: Take an active role in your legal case and medical treatment. Stay informed about the progress of your claim, attend appointments, and keep detailed records.

Seek Support from Trusted Professionals: If you suspect predatory practices or feel unsure about your legal or medical situation, seek support from trusted professionals.

The Federal Employers Liability Act (FELA) is a crucial piece of legislation protecting railroad workers across the United States. Congress enacted FELA in 1908 to compensate railroad employees who suffered injuries or lost their lives due to their employer’s or fellow workers’ negligence. This blog explains what the Federal Employers Liability Act is and how and when it applies to injured railroad workers.

FELA holds railroad companies accountable for providing a safe working environment for their employees. It requires employers to take reasonable measures to protect their workers from harm, such as maintaining equipment, providing proper training, and ensuring a hazard-free workplace. When a railroad company fails to meet these standards and an employee is injured, FELA allows the injured worker to seek compensation.

Unlike traditional workers’ compensation systems, the Federal Employers Liability Act operates on a fault-based system. This means that an injured railroad worker must prove that their employer’s negligence, in whole or in part, caused their injury. Even if the employee’s negligence contributed to the accident, they may still recover damages, though the amount may be reduced by the percentage of their fault.

What Does The Federal Employers Liability Act Cover?

FELA covers various injuries and illnesses that railroad workers may experience on the job. These encompass injuries caused by accidents like slips, falls, and collisions, along with occupational illnesses stemming from exposure to hazardous substances or repetitive stress. Examples of common FELA claims are:

Injuries from train derailments or collisions

Slip and fall accidents due to hazardous conditions on the job site

Injuries caused by defective or poorly maintained equipment

Occupational illnesses, such as hearing loss, respiratory diseases, or cancer, caused by exposure to hazardous substances

Repetitive stress injuries, such as carpal tunnel syndrome or back strain, caused by repetitive motions or improper ergonomics

When railroad workers suffer an injury covered by FELA, they may be entitled to various types of compensation. These include:

Medical expenses: FELA requires railroad companies to pay for all reasonable and necessary medical expenses related to the injury, including hospitalization, surgery, medication, and rehabilitation.

Lost wages: If a railroad worker’s injury results in a permanent disability and prevents them from returning to work, FELA entitles them to recover lost wages, including future lost earning capacity.

Pain and suffering: Injured railroad workers may also seek compensation for the physical pain and emotional distress caused by their injury.

Disability: If an injury results in a temporary or permanent disability, FELA compensates for losing earning capacity and the costs associated with adapting to the disability.

Wrongful death: In the tragic event that a railroad worker loses their life due to a work-related injury, FELA allows the surviving family members to seek compensation for funeral expenses, lost financial support, and the loss of companionship.

How to Pursue a FELA Claim

To pursue a FELA claim, an injured railroad worker must initiate a lawsuit against their employer in state or federal court. The statute of limitations for a FELA claim lasts three years from the date of the injury, highlighting the importance of promptly taking action to safeguard your rights.

When you visit someone else’s property in Farmington Hills, whether a business along Orchard Lake Road, a public space, or a private residence, you expect a certain level of safety. Property owners in Farmington Hills and Oakland County have a legal duty to maintain their premises free of hazardous conditions, and in some cases, to reasonably warn visitors of potential hazards. If a property owner neglects this obligation and someone is injured, the property owner may be deemed liable under Michigan premises liability law. Here, the Davis Law Center discusses some of the more common types of premises liability claims arising in Farmington Hills, metro Detroit, and throughout Michigan.

Slip and Falls in Farmington Hills

Slip-and-fall accidents are the most common type of premises liability case. These accidents occur when a visitor slips, trips, or falls due to a hazardous condition on the property. Examples of conditions that can lead to slip and fall accidents include:

Wet or slippery floors caused by spills, leaks, or improper cleaning

Uneven or damaged flooring, such as cracked sidewalks or loose carpeting

Insufficient lighting that makes it difficult to see potential hazards

Cluttered or obstructed walkways

Lack of handrails on stairs or ramps

Accumulation of ice and snow

Oakland County Negligent Security Lawsuits

Property owners in Oakland County and throughout Michigan must also provide adequate security to protect visitors from foreseeable criminal acts. This duty applies to businesses, apartment complexes, and other properties where criminal activity is a known risk. In the context of businesses such as hotels and motels, the “innkeeper” has a duty to protect their guests from injury and must exercise ordinary care and prudence to keep the premises reasonably safe. Upthegrove v. Myers, 99 Mich. App. 776 (1980). When a property owner fails to implement reasonable security measures, and someone suffers an injury resulting from a criminal act, the property owner may be held liable under premises liability law and/or common law.

Examples of inadequate security-related injuries include:

Assaults or batteries in poorly lit or unmonitored parking lots

Robberies or muggings in buildings with insufficient security personnel or cameras

Sexual or criminal assaults in apartment complexes or hotels with broken locks or inadequate access control

Shootings or stabbings in bars or nightclubs with a history of violent incidents

To prove an inadequate security claim, the Davis Law Center will demonstrate that the property owner was aware or should have been aware of the potential risk of criminal activity on the premises and neglected to implement reasonable measures to avert it.

Swimming Pool Accidents

Property owners with swimming pools on their premises must take reasonable steps to ensure the safety of swimmers and prevent accidents. This includes providing proper fencing and gates to prevent unauthorized access, maintaining the pool and equipment in good condition, and posting appropriate warning signs.

Examples of swimming pool accidents that may be covered under premises liability law include:

Drownings or near-drownings from lack of supervision or inadequate safety equipment

Slip and fall accidents on wet or slippery pool decks

Injuries caused by defective or poorly maintained pool equipment, such as ladders or diving boards

Injuries resulting from inadequate pool maintenance, such as chemical imbalances or unsafe water conditions

Dog Attacks

Dog bites are another common type of premises liability case that the Davis Law Center routinely handles from its office on Northwestern Highway in Farmington Hills. In Michigan, dog owners are strictly liable for bite injuries inflicted by their dogs, regardless of the owner’s knowledge of the dog’s aggressive tendencies. If dog owners in metro Detroit allow their dogs to stray and the dogs cause injury, the owners can also be held liable under the Michigan Leash Law. If you suffer injury as a result of being bitten or attacked by a dog, the Davis Law Center will hold the dog owner accountable and make sure you receive the compensation you deserve.

Amusement Park and Carnival Injuries

Amusement parks and carnivals offer a variety of rides and attractions that can pose potential risks. Property owners and ride operators must ensure patron safety by properly maintaining and inspecting rides, providing appropriate safety instructions and equipment, and verifying that patrons meet the necessary height and health requirements for each ride.

Examples of amusement park and carnival injuries that may be covered under premises liability law include:

Injuries caused by mechanical failures or malfunctions of rides

Falls from rides due to inadequate safety restraints or operator error

Injuries caused by collisions or sudden stops on rides

Slip and fall accidents on wet or cluttered walkways in the park

When one person injures another in Farmington Hills and throughout Michigan, the law allows the injured individual to hold the at-fault party accountable by filing a personal injury lawsuit. This legal action allows our Oakland County and Metro Detroit neighbors to recover compensation for injury-related financial losses, such as hospital bills and lost income from missed work, as well as less tangible losses, such as pain and suffering. If you are considering filing a Michigan personal injury claim, this blog will hopefully help you understand the process and give you the confidence and clarity you need to do so effectively.

Seek Medical Attention

If you were injured in a crash at 12 Mile & Farmington Road or elsewhere in Oakland County, it is crucial to prioritize your health and well-being, even if you believe your injuries are minor. We recommend seeking medical attention as soon as possible to maximize your chances of a full recovery. Furthermore, visiting a doctor soon after the accident will help document a clear link between the accident and your injuries, making it harder for anyone to debate whether your injuries were a result of the accident or something else.

Gather Evidence

At the Davis Law Center, we believe a successful Michigan personal injury lawsuit depends on evidence. We recommend collecting police reports, witness statements, and photographs and video of the accident scene and your injuries. In the days and weeks that follow, keep records of medical bills, lost wages, a pain diary, and other accident-related losses. Place all these items in an evidence folder.

Contact a Farmington Hills Personal Injury Attorney

While you could try to file a lawsuit on your own, working with an experienced attorney will significantly improve your chances of recovering the full and fair compensation you deserve. At the Davis Law Center, we will investigate the accident, identify all liable parties, hire necessary experts, calculate the value of your claim, negotiate with insurers, and represent you in court if necessary.

Negotiate a Settlement

Most of our Farmington Hills personal injury cases settle before trial. In that regard, and after we have obtained all the necessary information regarding your losses, we will send a settlement demand to the at-fault party and their insurance provider, if relevant, explaining your position and the compensation you’re demanding. Next, we will negotiate with the insurance company and defense lawyers for a fair compensation package on your behalf. If a satisfactory agreement cannot be reached, we would most likely move forward with filing a lawsuit.

File the Michigan Personal Injury Lawsuit

A Farmington Hills personal injury lawsuit begins with filing a complaint with the appropriate Michigan court. Our complaint will outline the details of your accident, why we believe the Defendant was at fault, the injuries you sustained, and the compensation you seek. We will then serve the complaint and a summons on the defendant which notifies them of the lawsuit and the time frame in which they must respond.

Go Through Discovery

Once the Defendant answers the complaint, the court will issue a scheduling order with timelines for discovery, settlement negotiations and trial. During the discovery phase, both parties exchange information relevant to the case. This process may include depositions (sworn statements taken under oath), interrogatories (written questions), and document requests. The discovery phase allows both sides to assess the strengths and weaknesses of their respective cases and can often lead to further settlement negotiations.

Proceed to Trial

After the discovery phase, the trial court will usually order the parties participate in case evaluation or facilitative mediation in an attempt to resolve the case. If a settlement still can’t be reached, a trial will be scheduled and we will present your case before a judge or jury. We will argue on your behalf, present evidence, and call witnesses to testify. The defendant’s legal team will also have an opportunity to present their case. After both sides have presented their arguments, the judge or jury will render a decision and, if they find in your favor, award you compensation for your losses.

Slip and fall accidents can happen anywhere, at any time, and to anyone. Whether you’re walking through a Kroger supermarket, visiting a friend’s home, or strolling down a public sidewalk in Downtown Farmington, a sudden slip or trip can lead to serious injuries, mounting medical bills, and lost wages. These accidents are generally caused by the negligence of a property owner or manager who failed to maintain safe conditions or warn visitors of potential hazards. If you’ve been injured in a slip-and-fall accident in Michigan, you may be entitled to compensation from the liable party. However, it’s essential to understand that your right to take legal action is limited by a strict time frame known as the statute of limitations. Moreover, there are certain notice requirements must be complied with if suing a governmental entity. Read more to find out more Slip & Fall time limits in Michigan.

What Is the Statute of Limitations for Slip & Fall Lawsuits in Farmington Hills And Throughout Michigan?

Slip and fall time limits in Farmington Hills and Michigan are governed by statutes of limitations for Michigan personal injury cases and generally require injured individuals to file a lawsuit against the at-fault party within three years of the incident. This rule means that those who do not initiate legal action before the three-year deadline will likely be barred from recovering the compensation they deserve.

While three years might seem like a long time, the process leading up to filing a lawsuit can take longer than many people realize. We have found that securing evidence can often be challenging, and negotiations with insurance adjusters can sometimes be frustratingly slow. Furthermore, depending on the severity of your injuries, determining the total value of your losses can sometimes take many months. As such, we recommend seeking legal assistance as soon as possible after a slip-and-fall accident so your attorney can get started on your case.

What Is the Deadline for a Slip & Fall Lawsuits Against a Government Entity in Michigan?

Slip-and-fall time limits in Michigan differ when injuries are caused by a government entity, such as a municipality that failed to repair a dangerously uneven sidewalk. In these types of cases, you must file your claim within two years of the date of the injury. Furthermore, there are 120 notice deadlines, depending on the entity you are filing against. For instance, for claims arising from defective roadways or defective public buildings, the notice must be given to the appropriate governmental entity within 120 days from the date of injury. The Notice must specifically identify the exact location of the defect, the injuries suffered, and the names of all known witnesses. If your slip-and-fall occurred on a county-controlled road or bridge in Oakland County, the notice period is even shorter: just 60 days. Failure to comply with these notice provisions can be fatal to an injured person’s ability to recover damages.

What Steps Does The Davis Law Center Recommend To Avoid Missing the Deadline?

To avoid missing the deadline to file a slip-and-fall accident claim in Michigan, it is essential to act as soon as possible after the incident occurs. First, seek medical attention for your injuries, as this will provide documentation of the harm you have suffered.

Next, we recommend gathering any evidence you have related to the accident, such as photographs of the exact location where the injury occurred, witness information and statements, and the clothing and shoes you wore at the time of the incident. It is also advisable to consult with an experienced Farmington Hills slip-and-fall accident attorney as soon as possible. If you choose the Davis Law Center, we will help you understand the legal process, gather additional evidence, and ensure all necessary paperwork is filed before the limitations period expires. We will also handle all communications with insurance companies and negotiate on your behalf to secure the compensation you deserve for the harms suffered in the fall.

After a car accident in Farmington Hills, Michigan, one of the most pressing concerns for injured victims is how they will pay for their medical treatment. The state’s no-fault insurance system can be complex and confusing, leaving many people unsure of their rights and options. The Davis Law Center discusses paying medical bills after a car crash.

Michigan’s No-Fault Insurance System

Under Michigan’s no-fault insurance system, every vehicle registered in Michigan must be covered by liability insurance and optional PIP (personal injury protection) coverage, depending on your circumstances. A PIP policy may pay for lost wages, medical expenses, and other benefits for the vehicle’s driver, family, and passengers if they are hurt in a car wreck, regardless of who was at fault. When you are injured in a car accident in Michigan, you will typically turn to your own PIP coverage first to pay for your medical bills and related expenses. These are known as “first-party benefits.”

Personal Injury Protection (PIP) Coverage

As of July 2020, Michigan law allows drivers to choose from six different levels of PIP coverage, which provides for payment of medical bills following a car crash:

Unlimited coverage (Davis Law Center’s Recommendation)

$500,000 limit

$250,000 limit

$250,000 limit with PIP medical exclusions

$50,000 limit (for Medicaid-eligible individuals)

Opt-out (for Medicare-eligible individuals)

The coverage level you choose will determine how much your no-fault PIP insurer will pay for your medical expenses after a collision. If your medical bills exceed your PIP coverage limit, you may need to turn to other payment sources, such as your own health insurance, Medicaid, Medicare, or personal savings. If another driver was at fault, you may also attempt to obtain the excess benefits by suing him or her for negligence.

Coordinated vs. Uncoordinated PIP Coverage

When you purchase your auto insurance policy from a Michigan insurance agent, you may also have the option to choose between coordinated and uncoordinated PIP coverage. This is just an option, however, and your insurance carrier is not required to offer it to you.

If you choose coordinated coverage, your health insurance will be the primary payer for your accident-related medical bills, and your PIP coverage will be secondary. This means that your health insurance will pay first, and your PIP coverage will cover any remaining expenses. This choice may reduce your insurance premiums.

If you choose uncoordinated coverage, your PIP coverage will be the primary payer for your accident-related medical bills, and your health insurance will be secondary. This means that your PIP coverage will pay first, and your health insurance will cover any remaining expenses.

We recommend uncoordinated coverage because oftentimes, health insurance does not cover everything a no-fault insurer is obligated to pay. Health insurance may also severely limit the amount of care and services an injured car accident victim requires.

Other Sources of Payment for Medical Bills Following A Farmington Hills, Michigan Car Crash

If you choose less than unlimited PIP coverage, you may not be able to cover all of your accident-related medical expenses if you are involved in an accident. For instance, if you chose less than unlimited coverage and are involved in a crash at the intersection of Farmington Road and 13 Mile Road requiring hospitalization, your coverage could be exhausted in just a matter of days. If this happens, you may need to explore other payment options, such as Medicaid, Medicare, or your own personal savings or loans, for any further care you require.

This is why we recommend all our clients choose unlimited PIP coverage so that all bills are paid after a car crash. At the Davis Law Center, we can explain your options and pursue the compensation you need to cover your medical bills and other accident-related expenses.

The Role of Fault in Michigan Car Accident Cases

Although Michigan is a no-fault state, fault can still play a role in certain car accident cases. In cases where your injuries meet certain thresholds, such as permanent disfigurement, serious impairment of a body function, or death, you may be able to step outside the no-fault system and file a personal injury lawsuit against the at-fault driver.

In these cases, you may be able to recover additional compensation for your medical bills, lost wages, pain and suffering, and other damages. However, proving fault and liability in a car accident case can be challenging, and it’s essential to work with an experienced attorney who can fight for your rights.

The Importance of Seeking Legal Guidance

Navigating the complex world of no-fault insurance and medical bill payment after a car accident can be hard, especially when you are dealing with injuries and financial stress. Working with a well-seasoned personal injury attorney can increase your chances of getting the full compensation you deserve and having your medical bills paid in a timely manner.

When a dog bites someone, severe physical and emotional trauma can result, often leading to costly medical bills, lost wages, and a lengthy recovery process. Davis Law Center is a personal injury law firm that understands the complexities of dog bite cases in Farmington Hills, metro Detroit and all of Michigan, and is committed to helping victims seek the compensation they deserve. In this blog, we will discuss dog bite laws in Michigan.

Michigan’s Dog Bite Statute

Michigan has a specific law addressing dog bite liability. This law dictates that a dog owner is responsible for whatever injuries their dog causes, regardless of the animal’s previous behavior or the owner’s knowledge of its viciousness.

To recover compensation under the dog bite statute, the victim must prove:

The defendant owned the dog.

The dog bit the victim.

When the bite occurred, the victim was on a property where they were legally allowed

The victim did not provoke the dog.

Michigan’s dog bite law imposes strict liability on dog owners. This means that an owner is responsible for the injuries inflicted by their dog even if they had no prior knowledge of the dog’s viciousness or if the dog had never bitten anyone before.

Exception 1: UnLawful Presence

To be eligible for compensation under the dog bite statute, the victim must have been legally on the property where the bite occurred, either public property or private property by invitation. This means that if the victim was committing a crime or trespassing at the time of the bite, they may not be able to recover damages.

Exception 2: Provocation

If the dog was provoked, the owner might not be held liable for the resulting injuries. Provocation can include actions such as teasing, abusing, or tormenting the animal.

Negligence Claims

Sometimes, a dog bite victim may also have a claim based on negligence. For a negligence claim to succeed, the victim must prove:

The dog’s owner owed a duty of care to the victim.

The owner breached that duty of care.

The breach caused the victim’s injuries.

The victim suffered damages as a result.

Examples of negligence in dog bite cases may include:

Failing to train or socialize the dog properly.

Allowing the dog to roam freely without a leash (Michigan Leash Law MCL 287.262)

Failing to warn others of a dog’s aggressive tendencies.

Damages in Dog Bite Cases

People who are bitten by dogs in Michigan may be entitled to various types of compensation, including money for:

Medical expenses

Lost wages

Pain and suffering

Scarring and disfigurement

Emotional distress

Being involved in a car accident is shocking, but when the at-fault driver is uninsured, the situation can become complicated. As a Farmington Hills and Detroit-area personal injury law firm, the Davis Law Center understands the challenges faced by victims of uninsured motorist accidents and is dedicated to helping them navigate the legal process while seeking the compensation they deserve. The Davis Law Center discusses what to do if you are unlucky enough to have been hit by an uninsured driver.

Michigan’s No-Fault Insurance System

Michigan has a no-fault insurance system, meaning drivers usually must first get compensation from their own auto insurance policies for coverage after an accident, regardless of who was at fault. Under this system, most drivers carry personal injury protection (PIP) coverage, which pays lost wages and medical expenses for accident-related injuries. These benefits are available to persons injured in a crash, whether the other driver was insured or not.

No-fault coverage does not pay for damages like compensation for pain and suffering caused by a negligent driver, however. To obtain compensation for those types of damages, our Farmington Hills victims typically file a claim for compensation with the at-fault driver’s insurance company. In Michigan, to file and prevail on such a claim, the injured party must demonstrate he or she suffered a serious impairment of body function or permanent disfigurement in the crash. Claims for non-economic damages (pain and suffering) against an at-fault, uninsured driver are more complicated, however.

The Problem of Uninsured Drivers And The Importance Of Obtaining Uninsured Motorist Coverage Through Your Own Insurance Company

Despite Michigan’s mandatory insurance laws, many drivers in Farmington Hills, Detroit and throughout the state choose to drive without insurance. If these uninsured drivers cause an accident, victims may face significant obstacles in recovering the compensation they need to cover their losses. This is mainly because if a driver cannot afford insurance, they also probably cannot afford to pay your damages resulting from the crash. This is why we recommend everyone purchase “Uninsured Motorist Coverage” (UM) from their own automobile insurance company, if available. UM coverage will pay you what should have been paid by the at-fault driver, up to the limits you choose from your own insurance company.

For instance, say you were struck by a hit-and-run driver at the intersection of Maple and Orchard Lake in West Bloomfield and sustained serious injuries. Let’s also say that prior to the crash, you had purchased $500,000 Uninsured Motorist Coverage from your own auto insurance company. Depending on the severity of your injuries, you would then be able to collect up to $500,000 from your insurance company to compensate you for the pain and suffering you endured as a result of the negligence of the uninsured driver who hit you. If you did not have UM coverage in this scenario and the uninsured driver was never identified, you would have no recourse to obtain pain and suffering damages.

What To Do If Hit By An Uninsured Driver

If you are hit by an uninsured driver in Detroit, Farmington Hills, or anywhere in Michigan, we recommend you follow these steps to protect your health and legal rights:

Call the Police

Contact law enforcement immediately after the crash. Law enforcement will create an official report of the incident, which will be important for your insurance claim and any legal action you may need to take. In fact, some insurance companies require a report to be filed within 24 hours of being hit by an uninsured driver to even pursue an uninsured motorist claim.

Get Medical Attention

Even if you feel fine after being hit by an uninsured driver, we believe it’s essential to get a medical evaluation as soon as possible anyway. Some injuries, like whiplash or concussions, may not show symptoms right away. Prompt medical care can protect your health and create a record of your injuries for your claim.

Gather Evidence

If possible, take photos of the accident scene, vehicle damage, and your injuries. Get the names and contact details of any witnesses who may have seen the accident occur.

Report the Accident to Your Insurance Company

Notify your own insurance company of the accident as soon as possible. Be honest and accurate in your description of what happened, but avoid admitting fault or speculating about the cause of the crash.

Check Your Uninsured Motorist Coverage

Review your own auto insurance policy to see if you have uninsured motorist (UM) coverage. This type of coverage can help pay for your losses if an uninsured driver hits you. In Michigan, UM coverage is not mandatory, but it can provide crucial protection in these situations. Moreover, it is relatively cheap coverage to add to your insurance policy.

At the Davis Law Center, we have noticed that Michigan’s no-fault car insurance system can be confusing for many drivers in Farmington Hills and throughout the State. As a car accident attorney serving clients for over three decades, Neil Davis at the Davis Law Center understands how this unique system works and how it affects you in the event of an accident.

What Is No-Fault Insurance?

Michigan’s no-fault insurance system generally requires all drivers to carry personal injury protection (PIP) coverage, with certain exceptions discussed below. If you are injured in an accident, your PIP policy can cover medical expenses, wage loss, medical mileage, and assistance with household chores or home nursing-type services (attendant care). These benefits are payable regardless of who was at fault. PIP coverage doesn’t apply to vehicle or property damage, however. Other coverages required by Michigan law are Property Protection Insurance (PPI) and Residual Liability Insurance (BI/PD). We provide an overview of the various coverages as follows:

Personal Injury Protection (PIP)

This is the “No-Fault” part of your automobile policy of insurance. PIP policies cover your medical expenses, lost wages, replacement services, medical mileage, and attendant care if you are injured in a car accident, regardless of who was at fault in the crash. As of July 2020, Michigan law allows drivers to choose from six levels of PIP coverage:

Unlimited coverage (Davis Law Center’s recommendation).

$500,000 limit

$250,000 limit

$250,000 limit with PIP medical exclusions

$50,000 limit (Medicaid-eligible only)

Opt-out (Medicare-eligible only)

We recommend unlimited PIP coverage because of the astronomical cost of medical care after serious injury accidents. We have had clients who opted for lower amounts, only to see those limits exhausted after a 24-hour hospital stay. At that point, and unless you have other insurance, you could be personally responsible for all past, present, and future medical care.

Aside from medical expenses PIP coverage can also provide:

Up to 85% of your lost wages (subject to an annual cap) for up to three years from the date of the crash, if you cannot work due to accident-related injuries.

Replacement services, such as household help, are available if your injuries prevent you from doing the tasks that you were able to do before the crash, but not after. These are also available for the 1st 3 years following a crash.

Attendant Care (home nursing services provided by either friends, family, or an agency)

Medical Mileage (reimbursement for mileage incurred while travelling back and forth to your medical providers)

Survivor’s loss benefits to your dependents if you are killed in a car accident.

Property Protection Insurance (PPI)

PPI coverage pays for damage your vehicle causes to other people’s property, such as buildings, a fence on Grand River, or parked cars. The minimum required PPI coverage is $1 million.

It’s important to note that PPI does not cover damage to another person’s vehicle unless it was parked at the time of the accident. You would need to rely on your collision coverage or the other driver’s insurance for damage to other vehicles.

Property Damage (PD)

PD coverage in Michigan requires a minimum coverage of $10,000 to protect you if you cause damage to another individual’s vehicle outside of the State of Michigan. If you have ever taken a damaged vehicle for repairs, you know $10,000 barely covers anything. This is why we recommend at least $100,000 of PD coverage.

Residual Liability Insurance

This is where “Fault” comes into play in the Michigan No-Fault scheme. Residual liability insurance, called bodily injury and property liability coverage in other states, covers injuries and property damage others incur when you cause a crash. The minimum required coverage is:

$250,000 per person for bodily injury

$500,000 per accident for bodily injury

While drivers may choose to lower the coverage to $50,000 per person and $100,000 per accident, these are minimum requirements and not recommended. We believe it’s smart to purchase higher limits to protect yourself in the event of a serious accident. For instance, if you blew through a red light at 12 Mile and Orchard Lake Road, and the other party’s losses exceed your liability coverage, they could sue you personally for the remaining amounts. If you chose to lower your coverage to $50,000 and an Oakland County jury entered a verdict against you for hundreds of thousands of dollars, you could be ruined financially. In our opinion, the more residual liability coverage, the better.

Limitations of No-Fault Coverage

While Michigan’s no-fault system provides essential benefits, it also has limitations:

No-fault insurance does not cover vehicle damage. For this, you need collision and comprehensive coverage.

PIP insurance also does not cover pain and suffering damages. Compensation for pain and suffering is only available if your injuries meet certain thresholds, such as serious impairment of a body function, permanent disfigurement, or death. You also must prove that the other driver was more than 50% the cause of the crash.

For many Americans, the approach of summer is synonymous with enjoying a road trip. Michiganders are no exception, and our state provides some of the most stunning scenery in the country. However, whether you intend to enjoy a journey along the shores of Lake Michigan or through Mackinaw State Forest, it is essential to keep safety at the forefront of your plans.

Check out the following guide to help you stay safe from harm as you enjoy your summer adventures.

Pre-Trip Preparation

Before embarking on your summer road trip in Michigan, proper preparation is crucial for a safe and smooth journey. Start by ensuring your vehicle is in top condition through regular maintenance checks. Inspect your tires for proper tread depth and inflation, check the brakes, fluids, and lights, and consider getting a professional inspection if your vehicle hasn’t been serviced recently.

Next, plan your route carefully. Research the best routes and alternatives, taking into account potential traffic patterns and construction zones. Be sure to factor in rest stops and breaks to avoid fatigue, and allow for unexpected delays.

Finally, pack essential items for your trip. This includes a first aid kit, emergency supplies (such as a spare tire, jumper cables, and flares), snacks, and beverages to stay hydrated. Keep important documents like your insurance and vehicle registration handy, and ensure proper child safety restraints are in place if traveling with little ones.

Safe Driving Practices

While on the road, practice the following safe driving habits to minimize the risk of accidents.

Avoid distractions by refraining from using your phone or other devices while driving, and limit other potential distractions like eating, drinking, or adjusting controls.

Obey all traffic laws, maintain a safe speed limit, and follow traffic signals and signs. Be especially cautious in construction zones, where hazards and unexpected changes may occur.

Employ defensive driving techniques to help you avoid potential dangers. Maintain a safe following distance from the vehicle in front of you, constantly scan for potential hazards, and be prepared for unexpected situations, such as a sudden lane change or a vehicle entering your path.

Manage fatigue by taking regular breaks to rest and stretch. If you start feeling drowsy, switch drivers or find a safe place to rest. Avoid driving late at night or early in the morning when your alertness may be compromised.

In Case of an Accident

Despite your best efforts, accidents can still happen. If you are involved in a collision, stay calm and safeguard the scene. Move your vehicle to a safe location if possible, turn on your hazard lights, and use warning flares to alert other drivers.

Call for emergency assistance if needed, and then document the incident. Exchange contact and insurance information with the other parties involved, and take photos or videos of the scene and any damage. Obtain contact information from witnesses who may have seen the accident happen.

Finally, seek legal assistance from an experienced personal injury attorney. They can help protect your rights and guide you through the process of pursuing compensation for your injuries, such as medical expenses and lost income.

Involved an Accident During a Summer Road Trip? Contact Davis Law Center Today

While advance planning and attentive driving can significantly reduce your chances of being involved in an accident, the negligent actions of another road user can put you at risk at any moment. If you suffer injuries in a car accident during your summer road trip because of another party, the experienced legal team at Davis Law Center can help.

Riding a motorcycle offers a convenient, cost-effective, and fun means of commuting, running errands, and enjoying Michigan’s natural beauty. Yet with these advantages comes an increased vulnerability. Motorcycles are less visible than other motor vehicles, increasing the risk that inattentive drivers might cause accidents. Furthermore, motorcycles do not offer the same level of structural protection as passenger vehicles, exposing riders to a higher likelihood of severe injuries in the event of a collision.

For these reasons, Michigan has in place many safety laws that apply to motorcyclists. Chief among these regulations are the laws regarding motorcycle helmets. According to U.S. Centers for Disease Control estimates, motorcycle helmet use saved over 1,800 lives nationwide in a recent year. Following Michigan’s motorcycle helmet laws can help you avoid fines, license suspensions, severe injuries, and even death.

Helmet Requirements for Motorcycle Operators

In Michigan, motorcycle operators under age 21 must wear an approved crash helmet at all times while riding. However, operators aged 21 and older can choose to ride without a helmet if they meet certain conditions.

To legally operate a motorcycle without a helmet, the operator must have at least $20,000 in first-party medical benefits insurance. They must also have either held a motorcycle endorsement for at least two years or passed an approved motorcycle safety course. It is essential for operators to be aware of these requirements and ensure they meet them before deciding to ride without a helmet.

Helmet Requirements for Motorcycle Passengers

Passengers on motorcycles in Michigan are also subject to helmet laws. Passengers under age 21 must wear an approved crash helmet at all times, regardless of the operator’s age or qualifications.

Passengers aged 21 and older can ride without a helmet only if they have at least $20,000 in first-party medical benefits insurance in addition to the insurance carried by the motorcycle operator. This means that even if the operator is legally allowed to ride without a helmet, the passenger must still meet the insurance requirement to do so.

Approved Crash Helmet Standards

When wearing a helmet, both motorcycle operators and passengers must ensure that their helmets meet the safety standards set by the U.S. Department of Transportation (DOT). DOT-approved helmets have undergone rigorous testing to ensure they provide adequate protection in the event of an accident.

Wearing a non-DOT-approved helmet, such as a novelty helmet, does not comply with Michigan’s helmet laws and may not provide sufficient protection. Always look for the DOT certification sticker when purchasing a motorcycle helmet.

Penalties for Violating Motorcycle Helmet Laws

Violating Michigan’s motorcycle helmet laws can result in fines and legal consequences. Operators and passengers who do not wear helmets when required may be subject to citations and significant fines. Precise penalties vary by jurisdiction.

More importantly, failing to wear a helmet significantly increases the risk of severe head injuries or death in an accident. While helmets cannot prevent all injuries, they can significantly reduce the severity of head trauma and improve the chances of survival in a crash. Motorcyclists must understand and follow Michigan’s helmet laws to protect themselves and their passengers.

While drivers aged 21 and older who meet the appropriate qualifications are not required to wear helmets in Michigan, helmet use can save your life and prevent severe head trauma in the event of an accident. However, even if you are not wearing a helmet, you have a right to file a claim against an at-fault driver who injures you in a motorcycle crash. Working with an experienced Michigan motorcycle accident attorney can optimize your chances of a successful outcome for your case.

After suffering injuries in a car accident in Michigan, you might receive a call from the at-fault driver’s insurer. As this is the company you will file your injury claim with, you might think they are reaching out to help process your claim more efficiently. However, even though they may present themselves as concerned for your well-being, it would be a mistake to assume that the insurance adjuster is on your side.

Insurance companies are for-profit entities whose primary concern is minimizing the amount they have to pay out when someone files a claim. As such, the main purpose of any communication they initiate is to find ways to reduce or deny your compensation. Here is what you should do if you receive a “courtesy call” from someone else’s car insurance company.

Do Not Agree to a Recorded Statement

When an insurance adjuster calls you, they may request that you provide a recorded statement about the accident. They might frame this as a routine part of the claims process, but agreeing to a recorded statement is never in your best interest. The insurance company can use anything you say in the statement to dispute your claim, and even an innocent mistake or inconsistency could jeopardize your ability to recover the compensation you deserve.

The best course of action is to politely decline to provide a recorded statement and direct the adjuster to speak with your attorney. If you have not yet hired a lawyer, let them know that you will not discuss the accident until you have legal representation.

Avoid Admitting Fault

Another tactic insurance adjusters use is to ask leading questions that trick you into admitting fault for the accident. They may ask if you saw the other driver before the collision or if there was anything you could have done to avoid the crash. Even if you believe you were partially at fault, it is crucial not to admit this to the insurance company.

Michigan follows a modified comparative negligence rule, which means that your percentage of fault will reduce your compensation. If the insurance company can get you to admit fault, even unintentionally, it could significantly hurt your claim. While we would not recommend speaking with the other driver’s insurance adjuster, if you do, ensure you stick to the most basic facts of the accident, such as the time, date, location, and the names of the individuals involved. Avoid speculation or opinions about who was to blame.

Speak to an Attorney Before Accepting a Settlement

In some cases, the insurance company may offer you a settlement soon after the accident, before you have even finished treating your injuries. While it may be tempting to accept this initial offer and put the whole ordeal behind you, settling too early is rarely a good idea.

The full extent of your losses may not be apparent until you have reached maximum medical improvement, which could be months or even years after the accident. If you accept a settlement before you know how much your claim is actually worth, you may end up with far less money than you need to cover your expenses and compensate you for your injuries. Always speak to an experienced car accident attorney before accepting any settlement offer from an insurance company.

Being involved in a slip and fall accident can cause life-altering injuries, leading to overwhelming medical bills, lost income, and physical and emotional pain and suffering. If the accident occurred on another party’s property due to negligence, Michigan law allows you to recover compensation for these and other losses.

Working with a knowledgeable personal injury attorney can help optimize your chances of a successful claim. Here is what you need to know about Michigan’s slip and fall laws, including recent developments that may improve your chances of recovering the compensation you deserve.

Michigan’s Slip and Fall Laws

In Michigan, property owners have a legal obligation to maintain their premises in a reasonably safe condition. This duty of care extends to both invitees (individuals invited onto the property for business purposes) and licensees (individuals on the property with the owner’s consent). Property owners must take reasonable steps to identify and address potential hazards that could cause slip and fall accidents.

This requires property owners to exercise reasonable care in maintaining their premises, including regularly inspecting the property, promptly addressing known hazards, and providing adequate warning signs for potential dangers that cannot be immediately fixed. Failure to take these steps may constitute negligence.

If a property owner’s negligence leads to a slip and fall accident, they may be held liable for the resulting injuries and damages. To prove liability, the injured party must demonstrate that the property owner knew or should have known about the hazardous condition, failed to take reasonable steps to address it, and that this failure directly caused the accident and resulting injuries.

Overturning of the “Open and Obvious” Doctrine

Until recently, recovering compensation in a slip and fall case presented a significant challenge for injury victims in Michigan. The law stated that property owners could not be liable for a slipping or tripping hazard if it was “open and obvious.” However, the Michigan Supreme Court overturned the “open and obvious” doctrine in 2023. As such, business owners must now work harder to prevent slips and falls on their properties. If you do suffer injuries in a slip and fall accident in Michigan, your chances of filing a successful claim may now be stronger.

What to Do If You’ve Been Injured in a Slip and Fall Accident

Protect your slip and fall injury claim by taking the following steps:

Seek Medical Attention – Even if your injuries seem minor, it’s still critical that you have a medical professional evaluate your condition. This not only ensures that you receive proper treatment but also establishes a record of your injuries, which can strengthen your claim.

Document the Scene and Your Injuries – If possible, take photos of the accident scene, including the hazard that caused your accident, any visible injuries, and the surrounding area. Collect contact information from any eyewitnesses. Keep copies of your medical records, bills, and any correspondence related to your injuries.

Contact an Experienced Personal Injury Attorney – An attorney can gather evidence to bolster your claim and negotiate with insurance companies on your behalf. They can also advise you on the potential value of your claim and work to secure the compensation you deserve.
